An application for a citation, to com
pel O. T. Neibauer to produce in the
county court the will of his father,
Frederick Nelbauor, had scarcely been
filed this morning when the attorney
for the younger Neibauer brought in
the will and turned it over to the clerk.
The citation which was asked for by
P. B. Eder, executor under tho will,
therefore will not be necessary.
-The older Neibauer died Leeemhr 14
at the age of 83. In the will hp lia.i
provided that it be kept under seal by
his son until after the death of himself
and his wife. His wife is not yet dead,
and there was dissension in the family
over the estate. ,Eder knew that he
was named as executor, and he came
into court to compel the son to ni tha
will without further delay.
The will disposes of about $1,000

given to a son, Rudolph Neibauer. with
the proviso that he shall pay certain

Maud E. Cole has applied for letters
on the estate of her late husband. Al
bert L. Cole, asking that they be issued
to A. J. Johnson of Corvallls. He was
employed by the Southern Pacific and
is said to have lost his life as the re
sult of an injury received at Roseburg
