posed by Judge Gantenbeln this morn

utory charge.

Lexington, Ky., Feb. 14. Announce
ment was made today that the Ameri
can Tobacco company, known as tho
tobacco trust, will put to a test In the
higher courts thn Indictments returned
separately against Its agents. Attor
neys say that if the anti-trust lnw Is
upheld through all stages of the litiga
tion, and that if maximum fines are
imposed they will be bigger than the
one assessed In the ease of the Stand
ard Oil company by Judge Landls at
Chicago. The minimum fine could be
$8,000,000 and the maximum $80,000,000

afternoon charged with beating and se
riously injuring Arthur Mathews, a
son of A. . Mathews. lie was released
upon his own recognisance, and will

ing to answer the charges made against
him by Mr. Mathews.
"I called Mr. Muerhson over to mv
office," said Superintendent Rlgler,
'and asked him about the matter. I
thing his defense will be thst the boy
was not Injured bv him, but had suf
fered with trouble in his knee several
times, and had frequently remained out
of school because of It He said that
he paddled him llahtlv. but did not
break the skin nor hurt him severely
at any time. I am Inclined to bellevo
that he is correct in his statement."
Mr. Rlgler says that there Is no rui
ns: of the board ss to corporal pun
nhment. excepting- that It must be in
flicted by or In the presence of the
principal. There is no regulation
against the usa of a wooden paddle, and
most parnnta, tie says, are glad to have
their children whipped In school when

have been very few apples on the mar
ket. We . have sold some few Cana
dian apples this week, Baldwins from
18s to 20s. and Greenings from 17s to
20s. but the latter variety was not at
all satisfactory, Deing very aun in ap
pearance. With regard to Nova Sco,
tlans we have been making from 15s
to 16s per barrel for Baldwins, 16s to
18s for Golden Russets, and lis to 14s
for Greenings, but the bulk of this
stuff Is coming forward in poor con
ditlon, being undersized and dull In ap
