Judge Smith denies every accusation
made against him and denounces the au
thors of the circular in unstinted terms,
premising them that they - shall, hear
more from him in me future and defy
ing them to "get up In your desecrated
pulpits and. howl." In a signed com
munication addressed to the association,
the circuit Judge says:
"Upon my return to this city I found
the beautiful mea stirred up by the
holy men of God awaiting me and com
manding such attention as no decsnt
man desires to, give such a literary
monstrosity as they had thrust upon
this community,

Burroughs home on the north side of
the river caught fire last night and
damage to the extent of several hundred
dollars was caused by the flames and
water. Apparently the Are started from
a defective flue, for the blase was al
most entirely between the walls of the
second story. The fire department soon
had the flames under control, but con
siderable daman was dona bv uatr
and smoke and the chopping that waa
required in order to reach the blase.

Boyertown, Pa., Feb. 4 Alleged to
hav forged the name of Coroner R. E.
Strausser of Berks county, and to have
thereby illegally obtained the two gas
tanks figuring in the Boyertown theatre
disaster. W. R. Gavena -of Quaktertown
had a hearing last evening before Squire
Fox or Boyertown.
w. B. Bechtel, an attorney, siaiea in
behalf of his client that Gavena had
shipped the tanks in question on Jan
uary 14 to tnat place ror aaveruaina
purposes, as he considered that, having
been in the Are which killed 170 per
sons, they would draw crowds when
placed on exhibition. He afterward
grew frightened and returned the tanks
to Boyertown. it is alleged the tanks
were tampered with.
The express agents at Boyertown and
Quakertown testified that the tanks had
been shipped from Boyertown to Quaker
town and back. No explanation was
offered why the tanks had been re
moved in such a surreptitious manner.

clared by an examining board to be in
sane, Jack Chesterfield, the Seattle con
vict who was ordered Into custody Sat
urday by Governor Mead, ,was yesterday
ordered committed to the hospital fer
the Insane at Medical Lake by Judge
Brents. The officers feared that when
the Judge's decision was pronounced
Chesterfield would create a rough house
and four deputy sheriffs were in the
courtroom at the time, prepared to han
dle him If he became unruly. 'fb the
surprise of the officers Chesterfield
took the decision good naturedly. He is
held until an officer comes from the
asylum-
Chesterfield's malady Is csused by a
wound in the head he received at the
time he attempted to blow up the Seat
tle Jail. He was operated on by the
prison physician several months ago,
and since then he has shown rapid Im
provement. The authorities believe
that eventually Chesterfield will recover.

of the three children to Inherit the bal
ance of his estate. Mr. Hnvage did not
disinherit any of his children or grand
children, as had been commonly ru
mored, and in addition to the provisions
of the will, his grandchildren, children
of his deceased daughter, Mrs. Alk-e
Martin, will receive Jointly one-sixth
of the estate. George (). Savage is
named executor without bonds, and Is
also named trustee of the widow's
share of the estate. The will covers
four pages of typewriting, and on ac
count of practically an the farms In
tended for the children having been
deeded to them prior to his death, the
ameunt of his estate at the time of his
death is estimated at only $56,000.

and regulations Issued by railroad com
mission, which became effective Feb
ruary 1 are 10 In number.'
Rule 1 provides that holders of reg
ular trip tickets shall be entitled to con
tinuous transportation between the
points named within one day after the
date or Bale, and that cash fares col
lected on the train shall not exceed, the
maximum rates provided by law. This
rule changes the custom of the rail
roads in declaring tickets good only on
the day of sale and of collecting a pre
mium on cash fares.
Rule 2 provides that unused tickets
snail De reaeemanie by the railway com
pany within 60 days after date of aale
Rule 3 provides for the issuance of
Interchangeable mileage tickets for 2.00Q
miles at not o exceed $50, and pro
vides that the amount of mileage de-
lacnea, calculated at s cents per mile,
shall not exceed the cash fare regularly
charged.
