Case Against Banker and
Second Wife Looks Good

Decatur, Hi., Oct 12. Judge Coch
ran at noon adjourned the trial of for
mer Banker Fred H. MagllK and hla
young wife. Fay Graham Maglll,
charged with the murder of Mrs. Pet
Maglll, until Monday morning. There
was not a great deal of testimony ad
duced during the morning of substan
tial Interest to the state In Its attempt
to show that Fred Magtu and fay ura
ham administered the 'deadly chloro
form. Nor was the evidence strong
showing that they had conno-red to put
the woman and wire out or me way.
Mrs. Fred Kline of Clinton testified
that between 9:30 and 10 o'clock on the
night of May SO, during which Mrs. Pet
Maglll died, she saw Fred Maglll three
blocks away from his home, coming
from the direction of Fay Graham'a
home.
Mrs. N. P. Bundle, testifying aa to
the defective eyesight of Mrs. Pet Ma
gill, said:
"She told me she could not put on
her shoes without her glasses."
Dr. Myer, her physician, declared
that If she were without them for five
minutes their absence caused her vio
lent wrenching of the stomach.
Mrs. Louis E. Blome, one of the first
callers at the Maglll home the morning
after Mrs. Maglll's death, when asked if
ahe saw any one weeping, replied that
she had not. "Neither Maglll nor Fay
shed any tears," she said.
' "What was Maglll's attltudef ahe
was asked.
"Oh, he walked nervously up and
down the parlor floor and now and then
ezcialmed, 'Damn it all.' "
Mrs. Maud Felncr, the marriage 11
cenne clerk at Denver, who Issued the
license for Maglll and Fay Graham,
' testified that Maglll under oath had
said that he was a resident of Decatur
and that the girl was a resident of
Chicago.

case of J. H. Bowlsby, charged with the
mupler of Steve Jennings, June 14,
aboard the steamer Alliance, tonight
brought in a verdict of not guilty, on
account of temporary insanity-, after
being out less than two hours. The ver
dict meets popular approval.

under arrest while thef latter was en
route to Tacoma, between Mosler and
Hood River. Jones was brought to The
Dalles, where he is held to appear In
the Justice court for preliminary trial
October 22, on a charge of obtaining
money under' false pretenses. He Is un
der 11.000 ball and ha not raised the
