court adjourned for tha noonr recess.
Mr. Moser will probably require another
hour this afternoon before finishing his
argument and tha charge of Judge
Fraser to the Jury will take up some
time, so that the case will not likely
go to the Jury until lata In tha after

the status of the Mid-Oregon Railway
company which according to the report

land southward into tha Cascades. - The
preliminary report states that tha com
pany for various reasons has not been
able to carry out Ha plans. It 'seems
