' Ready is now at liberty and hla ball, $100. has been returned to him. . Nobody seems willing to accept the responsibility for the failure to prosecute himT" ""' It le admitted that there ie no city ordinance against the selling of 'pools nor against the making of handbooks. For this reason no city complaint could be, filed against. Ready. Deputy City Attorney Fltsgerald looked cloeely Into tne matter and so reported to the police. This being true, the authorities bad no right to hold Ready'a balL Court Clerk Frank Henneasy haa been criti cised for turning the money . over to Chief Grltsmacher, and the latter for returning it to Ready without an order or, police Judge Cameron. As no com plaint ws filed against the gambler he waa not under the Jurisdiction of Judge Cameron.. On the ether hand, -Chief Grltsmacher received the ball and was responsible for 'it .When Ready'a counsel made a demand on him 'for the money, no com- lint having him ni, ia hid no al ternative than to return it or have a suit at law. - It has also been said that Ready waa willing to plead guilty and be fined lla. The police assert that the utter absurd ity of this contention is shown by the mere fact that no man can plead guUty and be fined for something of . which he haa not been accused.
