Denies It Is Greater Crime to
Wager on Races Than
on Elections.
ARGUMENTS ON DEMURRER
TO HIS INDICTMENT
Judge M'Ginn Speaks Strongly
for Prosecution, and Case Is
I Taken Under Advisement.
"It la no more a crime to wager upon
the i. suit of a horse race than It Is
to wager upon the result of a presiden
tial election."
This Is the statement made by John
M Oearln. In the argument to the de
murrer Interposed to the Indictment
against M O. Neaae, charged with con
ducting a poolroom. That the result
of the case will depend Almost wholly
upon the decision of the court On the
demurrer Is the opinion of the attor
neys Interested.
The defense dtd not deny that Nease
conducted the poolroom, and sold pools,
but Insisted that doing so did not make
him Hnble under Uts section of Ue oode
defining nuisances. His attorneys con
tended that public decency was not out
raged, and unless the prosecution could
show that It was, the Indictment would
fall, because there oould be no conten
tion that the public peace had been dis
turbed. Deputy nistrlct Attorney Moser con
tended thst the nnlsance statute had
been enacted by the legislature with
the express Intention of covering all
sorts of crime not otherwise provided
against, and that conducting a pool
room come under this head.
Judge McGinn made a strong argu
ment for the prosecution, holding that
the operation of the poolroom, the con
gregating therein of lewd and disso
lute persons who were Induced to bet
their money and waste their substance
In this sort of gambling were aa out
rage to public decency, injured public
morals and disturbed the public peace,
within the meaning of the statutes.
At the conclusion of the argument
Judge George took the case under ad
visement Briefs were submitted by at
torneys for the defense and proeecutlon,
and Judge McOInn Is preparing a brief
which he will submit as a friend of the

Yet Ethel Kellogg says her husband
left the home In Kdendale to reside with
bis mother in Portland, leaving lira
Kellogg without any means of suste
nance. But before he did this, she says,
he hired a dray, backed It to the curb
in front of the home, went Into the
house, pointed to the wagon and sug
gested that she load thereon her
clothes, goods and chattels and depart
thence. She refused to go and the
dray departed empty. Next day, No
vember It. he packed up his goods and
chattels, went to his mother and
brought suit for divorce.
In her answer (lied she states that
very complaint which he made was
without cause, and was made aolely for
the purpose of humiliating her. In re
taliation she flies a cross-bill asking for
a- dlveroe -ott the grounds of cruel and
Inhuman treatment'. She also aska the
court to grant her a one third Interest

The Executive Board Believes
Penalty for Assaulting
Crane Was Too Light.
"Weed out all' your drunken men and
'scrubs,, " was the Injunction giving to
Chief Campbell of the fire department
by EM D. Curtis of the fire commis
sion at a meeting held yesterday after
noon. "That's what to do. We don't want
anybody but first-clans men In the de
partment," remarked William Flledner.
This was in course of a discussion of
the care of the large fire engines for
which the city paid over 16,800.
Chief Campbell waa aaked if a
drunken driver might not easily wreck
one of the engines, and replied that It
would be an easy matt for a drunken
driver to have a smash up.
Mayor Williams informed the board
that the municipal water board had manl
feated an Inclination to make a large
appropriation next year for fire hy
drants which will furnish every section
of the city, and that In all probability
the fire hydranta would be made a part
of the municipal water system.
A big fight Is Imminent In the execu
tive board this afternoon over Captain
William Hanson of company No. J,
against whom M. L Crane brought
charges of battery and asked to have
the captain dismissed from the depart
ment. It developed at the hearing that
Crane and his fellow politicians were
after Hanson's scalp. After hearing all
the testimony, the fire commissioners
fined Hanson 125 and ordered him re
moved to a different company. The ex
ecutive board took exceptions to the
findings, on the ground that the penalty
was not severe enough, and referred
the matter back to the commission for
more testimony, after hearing which the
commissioners adhered to their verdict.
It la rumored that the report of the
commisKloners will not be accepted and
that an effort will be made to discharge
Hanson.
Commissioner Ed D. Curtis stated yes
terday that he Is ready to fight If they
attempt to change the verdict.
DIPHTHERIA CAUSES
SIX DEATHS IN MONTH
According to the monthly report of
Dr. H. R. Blersdorf, city health officer,
diphtheria and scarlet fever have been
very prevalent In this city during No
vember and there have been several
cases of typhoid fever. There have
been 20 cases of diphtheria, from which
6 deaths have resulted. 11 cases of scar
let fever and of typhoid, one death re
sulting from the latter.
Many of the diphtheria caaas reported
have been nf the virulent type and it
has been only with the greatest oars

One remarkable thing la that small
pox has not appeared in Portland this
winter, and from all indications this
city will be quite free from this disease
this season.
There were 11 deaths during the
month, of which 7 were over (0 years
of age. 12 over 70, 21 over 10 and 44
over 60. There were 121 births, of
which it were males and 64 were fa
males, showing that there were 16 more
boys born than girls.
Heart disease claimed 16 victims and
consumption II. Pneumonia was quite
prevalent, there being I deaths from
this disease. Only ( deaths resulted
from violent causes. Two Individuals
died from fracture of the skull, one
from gas ssphyxlatlon, one from drown
ing, one from gunshot wound and one
from carbolic acid polaoning.
' Kerb one of the. Oregon presidential
electors will want to be the messenger,
of course. The Baker City Democrat
says It la likely to be J. N. Hart of that
city. ' .
