Secretary Irwin Mahon of the Ameri can mining congreas haa prepared tho following paper on "Mining Laws," In which he makes a plea fop the establish ment of a department of mlnea and mln -Ing la th United States, The subject will come up for consideration at the meeting of the mining congreaa n this city. . Mr. Mahon aays: . "Th mining law of th country have stood aa they ar for mora than to year. The first federal statute enacted In respect to mining and locating claims upon the publlo domain was pasaed in lstt. and amended In 1471, and remains unchanged up to the present time, with the exception of some slight enactments. 'When congreas enacted the laws of 11C4 and 1471, litUe waa known of tha formations so familiar to th practical miner pf today. They need revision, because at first they were crude and we have outgrown them. , New conditions have arisen, and with time and expe rience w have learned the difficulties that aria under- them aa they" ar now, and such changes as are made 'ahould be considered first by those directly In terested -In the mining Industry, and then presented -to our national and state law maker through th united vote of a representative body, such as tbs Amer ican mining congreaa. - "Again, w ha v had a great amount of costly and useless litigation, . much of It a grevloua burden upon th min ing Industry, and greatly to th injus tice of the prospector and Individual mining man of limited means, and moat if not all of it due to the Insufficiency, of th law by which tltlea are acquired. Certainly the uniformity f th loca tion claims ahould- be nxaL- that there be no diversity of adjudication whan theae questions com into ouf courts, and th prospector, the forerunner that ellmba the hills, encounters the danger and undergoea the hardship by which discovery is mads of our vast and varied mineral' depoelta. may easily 'be -informed as tJ th law In th locality where he makes his discovery, and pro tected by the assurance that' tho law as applied In on location is th earn In all. . - "In th flrat. experience of th pros pector th search was for placer gold, with no thought of lodes or leads, and without thought of silver, and by reaaon of both practical and theoretical Igno rance of condltlona, tons upon tona of pxeclous materials wer thrown away for years without any on realising its value...' -. -. . . Much Costly Utlgattoa. "Regarding the question of lodes and leads; tbr discovsry of which followed the 'discovery . of placer gold, waa lo cated In blanket velne, flat veins and fis sure vain, th flat -and flaaur veins be ing almply cracks in th earth's sur face, filled with mineral, a ws sup pose, either from volcanic Influence from below or from water above, that which oocura by reaaon of hurfao in fluence being - oxidised or and that which comes from th body or from volcanlo Influences being of a different quality of ore. .After years of practical experience, obeervatlon and develop ment It waa discovered that these veins In many locations war flat or wavering, and in defining tho property rlghta of tho prospector and miner endless litiga tion began and has continued up to th prnt tlm in many of our mining ous trlot aa to tho rlghta of th party own ing tho apex to follow th vein through hi neighbor' ground by reason of a dip in the aame. And -until -ail ueh questions ar regulated by law will much litigation of a grevloua character prove a burden upon tho mining In dustry. . "There are larger mining districts to bo found and. developed than w have any knowledge of today, and if , th American . mining congress can bo th meana if mining man and those Inter ested In th mining industry do their duty and lend th necessary financial aid and practical Information on all questions to be considered that they know should be given It of finding aa equitable adjustment for th ooatly lltl gatlon which has been th millstone hanging around th neck or mining. It will havo accomplished a purpose well worthy of ta greatest sfforta. weed of Pederal Aid. i-1n no department of-Industry can government aid and supervision be of such direct and Immediate benefit By ayatematlo exploration of tho moun tainous portion of th publlo .domain, vast bodies of minerals may be brought to light which otherwise would long re. main unknown. Every Invention which utillsee ore -ithtrto unavailable. Is a benefit to tho whole country. An ira proved process which cheapens the treat' ment of mineral, even a alngle dollar per ton, very largely Inoreases tho pro duction Of metal and tho extent of th mining lnduatry, aa th amount of or Increase in a surprising ratio with ach reduction of grade. It would be - th buslnesa of th department by an ex haustive aerie of experiments, to dis cover or Invent processes of treatment mechanical or ohemloaL which will re duce to a minimum tho expense of treat ment By tho dissemination of Its re ports, it would draw attention to th valu oi mineral mat ar now oauy pasted over unnoticed. 'In fact the methods in which sys tematic investigation and - sxpSrlmsnt can inoreas the. mineral product ar mor numerous than w can imagln la advance of experience.- Thar ar im perfection In our national law which retard prosperity and production, which Individual seera powerless ' to amend, but which could be remedied without delay or recommendation of a mining de partment For Instance, ia dealing with the large area of mineral lands within th boundaries of land grant mad by th government of Spain and Mexico, the United State expressly reserve all gold, silver and quicksilver, presumably for the benefit of the discoverer or worker; thus providing a dual owner ship heretofore, unknown to our lawa But though more than 10 year have passed, not the align test provision baa been' mad for th uae of any of those minerals; and so they remain unpros peeted end unworked. With a cabinet officer to attend to th Interests of the mining community, this need. would have been officially presented, to eoogreaa, and remedial legislation obtained year go. ' "In every way th ua of metallic and Industrial minerals . Is being Increased In a tapid rate, year by year, and metal la taking the place of wood and other material. - ' , .. v An Minora tntereeted. "In thla subject th miner of all sec tion and of every class are equally con cerned. Those who are Intereated in the coal of Pennsylvania, th copper of Michigan, the iron of Wuwonatn or Ala bama or the lead and sine of Missouri, unit with their far-off brethren of.tr. gold and silver region of tho Rocky mountains sod th Pacific slope In de manding thla encouragement and de velopment of the" buslnesa In which all are engaged. And the people at large have no lea interest, aa. every improve ment made In th extraction and treat ment of ore, leaaena th prlo f all article of tnetalllo material. "The establishment of a department of mining will not only be a proper recognition of the Importance and mag nitude of this great lnduatry, but will have an inspiring practical effect in stimulating invention and Industrial ad vancement knd th development f re sources now dormant and useless. . "Other countries with not one-tenth of our annual mineral output hav min isters and department devoted to min ing; let ua, in the United State, not be behind them in granting thia national encouragement and aid to th mining ln duatry or our own land." . : ROSEBUD LAND RUSIT LIKE CHARGE OF ARMY , (Continued from Pag On a) drawing in group of 104 each will be made by th department Those person In th first group of 1 to 100 will havo an aealgned flrat date on which to make their aelectiona, those In group 101 to 00 will have aaoond place, and ao on.
