LARGEST DAYLIGHT" ST IN NORTHWEST FIFTH AND WASHINGTON STREETS BILLION OR ORE (Journal Special Service.) "Washington, Jan. 14. Senator Lati mer of South Carolina mads a speech .today In advocacy of his bill creating 'the bureau of highways and carrying an v appropriation of 124,000,000. He said this amount should be divided equally between the states and territories ac ' cording to their population, the mlnl ; mum allotment being a quarter of, a million to any state having less than three-quarters of a million inhabitants. ' The bill further provides that any state or territory , receiving ( such a benefit 'must contribute dollar for dollar from her own treasury. The senator placed the surplus in the government treasury at $268,000,000, which he declared really "" belongs to' the" people. He declared It to be wrong to hoard the people's money. He said It was not necessary to meet , 'the public debt before i07' and all cur " rent expenses had been provided for. r He contended better roads were a na ' tional necessity, therefore a proper ob- Jeet Of, national aid. As rivers and harbors were improved, so should the highways. He declared the average ost of transportation per ton over a mile of ' dirt road In America was 25 cents, while In Europe on Improved roads it was 10. He denied ; that the government was liable to be .bankrupted by the project : and said a billion dollars would put all the main, roads in good condition and .. would require from the government but $50,000,008 per year for . 10 years. rrl MINISTER ON TRIAL (Continued from Page One.) she struck the match,, but the recogni tion came when she returned with her father. There were no other men about the house. Talbot had worked about the farm off and on, but was not there that night. She had seen Kennedy masked at a. Christmas entertainment. The man ,, ner of the burglar was very deliberate and gentlemanly. The state Introduced a newsDaner cllc- plng received anonymously looking to - prove that the defendant had attempted " to Intimidate the wltnesss, but the court ruled It out as Kennedy could not be ' connected In any with the incident. On cross-examination the witness testified - that she did not know that the defend ant was familiar with the bams of tier father's place, ''7 opening' f. Case. .. ' In the exciting - Kennedy burglary case the state 1s represented by Pis trict Attorney Harrison Allen and his deputy, K. B. Tongue. The defense is conv icted by x-statl Senator 8, 8. Hue ton. local, and Judge H. IL Hewitt of Albany, Linn county. Tongue made ' the opening statement for the prosecu tion to the jury late yesterday, stating that a burglary of the Warren resi dence had been made early in the morn ' tnff of Tuesday, September 1, 1903; that kinder, would . Identify Kennedy, whom "he admitted was in Portland about S o'clock Monday evening, August 81, and ' was seen again Tuesday morning about 8 o'clock, but that between those hours -v he had a bicycle and had ridden to Hlllsboro, committed the burglary and ' returned. "' i '.. ' ,'. " for the Defense. ,, Huston, for the defense, briefly stated .to the jury what he would be able to prove. Hs client could not have oom- j mltted the crime for the reason that he was not at Hlllsboro on Monday night, August SI, or Tuesday morning, Sep-1 tember 1. At that time he was In Port " land. He had hired a bicycle, It Is true, v but he used it In conducting his bust ' ness, that of accident Insurance solicit ing agent: that starting after 7 o'clock ? In the opposite direction from Hlllsboro and did not - return till 11 o'clock p. m., or afterward, that he was known to have been In his room In the Multnomah lodging house between 11 and II midnight, that he occupied his bed that night, that. his wheel was seen In the hall next morning as early as o'clock and that It is a physical Impos sibility to make a round trip from Portland to Hlllsboro, a dlstanoe of 10 miles, in the night time oyer the moun tains within the time claimed by the prosecution. That next day, Tuesday, he went , about his usual business as fresh and cheerful as men do who have had an unbroken night's rest. ' Ta Ones) Testifies. ; The first witness to testify was Mrs. Macklnder for the state. . She Is a res ident of St. Helena, Cal., and at the date of the burglary was a guest with E. H. . Warren and his daughter, Miss Minnie, The three, were the only occupants of . the house on the night of the burglary. She testified that she saw . defendant Kennedy on the night of the robbery "as sure as anybody could be." She was first made aware of the presence of an intruder by the odor of chloroform. She . called to her hostess, sleeping In an ad- Joining room, then she felt a heavy hand on her shoulder when she cried louder, "Minnie." Miss Warren went to her friend and struck a match. By its sud den glare, she saw the man. She ran ou - of the room and down stairs ' crying, "papa, there is a man in Mrs. Mackln dor's room." . The burglar then stepped - out of the room so that as he stood by the door. she saw his outline with his , pistol In his hand. She then reeog- nlied him as the same man who had killed the snake.
