Kuhn began against the Washington Mutual Building & Invest ment association In. the state crlcult court yesterday afternoon. Kuhn asks that the association be compelled to re lease a mortgage upon a house and lot In Elizabeth Irving's addition and to re cover an alleged overpayment of $300. He says that in 1894 he borrowed 12,000 from the association through Its agent, the late Joseph H. Hawley, payable on or before the expiration of 84 months with Interest at 8 per cent, both princi pal and Interest payable monthly. A premium of per cent and dues on 20 shares of stock at 65 cents per month were also Included. lis w ley represented that the association was mutual and co operative and . lent its money to sub scribers: only, and all the stockholders had' the same privileges and shared equally in the dividends and -profits. Relying on these statements, Kuhn says that lie made payments of 133 a month; a membership fee of 121 and a cancella tion fee of 110, making a total of 12,687. He asserts that the representations of Hawley were false; that, the association was never a mutual co-operative and loan association; that it was organized for the purpose of allowing certain classes of stockholders furious and un conscionable rates of interest; that there were several classes of stock holders, each class having privileges "and benefits different from the others.
