He says Oscar is Innocent of the charge of incendiarism; that no rope was placed around his neck, and that he was forced to make a con fession by Jennings, the saloonkeeper. who held a revolver to his head . They took him into a room and put him through a sweating process: They threatened to kill him, and the kid had to confess to save his life there and then. He is now, in Albany, which, is the county seat. Phil and I will retain a Portland lawyer today, possibly W. . Hume, and send-hlm to Albany to defend Oscar." EXAMXBXD AT ALBAHT. Albany, Or.. Dec. '22. The preliminary examination of Oscar Rogoway, the Leb anon incendiary, waa held at that place late yesterday afternoon before Justice George P. Lovelee and the defendant was placed under $2,000 bonds to await the action of the circuit court, which convenea in, March. He waa brought to - the ' county jail here. When Interviewed in his cell at a lata hour last - night . he talked very '- freely ; con cerning the fire, but he maintains that he is innocent. ' He related in detail .bow he discovered the flames and his actions after he aounded the alarm. He was sleeping in the back part of the store and says he was almost suffocated when the noise, of ttie fire aroused him.- He grabbed bis clothes and rushed across the street to tba hotel, where he awoka the occupants. After the Are was out he retired to a room in the hotel, but in a short time was told by some one pn the outside that a party wanted to' see him. When he reached- the sidewalk several men grabbed him, be claims, and told him if he did not confess he would be lynched. A noose was placed over his head and he was stretched up to a convenient limb- of a tree until his feet were clear' of. the ground; Finally ha confessed that he was hired to do the deed. A number of citlsens of Lebanon scout the story that ' any attempt was made to lynch the suspect. SUES SON-IN-LAW FOR MONTH'S BOARD Mrs. Mary Muchow asks for Judgment of $2 against her son-in-law and daugh ter, Gustav and Meta Wegner, asserting that they owe her a month's board and room rent, from June 11 to July 11, 190S. She filed suit in Justice Reld'S court The plaintiff is tha wife of an employe at tha city crematory, residing near Guild's lake. . ' The answer filed by Attorney Charles Petrain for the defendants this morn ing denies that they owe Mrs, Muchow $26, but admits that she Is entitled to $5.20 or 86 2-8 cents a day from June 11 to June 16, when they say they left Mrs. Muchow's . root. , The mother-in-law wants an entire month's board, - The case will be tried this week. CANNER IS SHARP -, B WITH VAN DUSEN : "If State Fish Commissioner Van Du sen would spend a little more time act ually at work and less in getting out reports, he would accomplish more," de clared F. A. Seufert, owner of a can nery at The Dalles, who Is in Portland today. "The state Intends turning Its hatcheries over to. the government next year, and the sooner this Is done the bet ter. Last season the hatchery of the government at Little White Salmon. Wash., turned out 89,000 fish. What have the Oregon hatcheries to show, in comparison? Since the first . hatchery was established five years ago- $90,000 has been expended and' the only things that show for this money, aside from the Ontario hatchery,, are a few small buildings scattered through tha woods. It costs the state more to raise 10,000 salmon than It does the government to produce l,ood,000, '.The Little White gal matt hatchery costs $3,600 a year. "I received a letter the other day from United States Fish Commissioner Bowers In which be offered to- take over the Oregon hatcheries and his proposi tion should be accepted. The govern ment has a number of experts employed who understand the culture of fish. - The only thing Van, Dusen has done is to demonstrate that fish hatcheries are practicable. - "As to Van Dusen' s idea that sawdust in the streams . WOBTK OT TBS ZBBBAFVBA. , Expressions of sorrow were heard all along the waterfront, this morning con cerning . the mysterious disappearance of Captain Porter from the - Oriental liner Indranadl while the vessel was lying in Brooklyn harbor, N. T., a few days ago. . It is generally believed that the missing man met with foul play. Captain Holllngsworth of the steam ship Indrapura, now In port, received a cablegram last evening from T. B, Roy den of Liverpool, owner of the Indra line of steamers, confirming . the news of the disappearance, but no additional light was thrown on the subject. The missing officer was last seen on the morning of December 12, at which time he left the vessel to go to the custom bouse. The steamer' was scheduled to sail the following day, but as the cap tain failed, to put in an appearance the sailing date was postponed a couple of days. A thorough search has failed to reveal . bis whereabouts. The - vessel finally put to sea in command of the first officer. , Captain Porter was formerly first of ficer on the Portland-Aslatlo steamship Indra velli, and ia well and favorably known at this port. He has a wife and two children who have been temporar lly residing at Kobe, Japan. Officers on the Indrapura feel his loss greatly, all of them having formed a strong attach ment for him. Secretary C. F. Martin stated this morning that he knew nothing ot the matter, but that the ' appointment of Mr. Shlllock to the position would meet with no objection from him.
