In course of time the debt became dne and a foreclosure suit was com menced berore Judge Boise of the M Dist., and was afterwards appeal- I ed to the Supreme Court, controlled as we have said by air. Kelly and Mr. Prim. As we have above stated Gold Fnith was a bankrupt, and before the suit for foreclosure was common :-.cd the $100,000 had entirely slipped in to Joe Teal's hands, who had with his peculiar cunning employed Gov ernor Thayer the creator of the court as his attorney, to conduct his case before the Judges of his own appoin: ment, and when the deeision was an nounced the legal fraternity of the entire Pacili i Coast were startled to .bear that Plaintiff j might take a judgment against the bankrupt Gold smith who borrowed the money, but could have no Judgment against thj full handed and wealthy Jo Teal. the only responsible party to the securi ty. This decision was exactly in ac cordance with the argument present ed by that great genius, uls Excellen cy Gov.
