CITY ATTORNEY REPORTS ON THE
RESULT AND PRESENT STATUS
OF AIL SUITS INSTITUTED BY OR
AGAINST THE CITY FOR 1907.
City Attorney diaries II. Abercrombie
reports to the common council the re
sult and present status of all suits in
stituted by, or against the city during
1W)7, and the probable result of those
now standing.
Acme Grocery & Dairy Co, vs. City
of Astoria was instituted for the pur
pose of testing the validity of the
amendments to the charter adopted in
lltoo and of determining whether or not
the city had' the power to adopt a
method of procedure by which the pro
posed amendments could be placed be
fore the people to lie voted on.
This case was taken to the supreme
court of the State of Oregon where it
was decided in favor of the city. The
principal value of the opinion was, and
is .that it determined the question in
the affirmative as to whether or not the
city equld devise its own method of
procedure, instead of waiting for the
legislature, eto.
The case of Henry JLukkala and John
Wuoplo vs. City of Astoria for some
extra work performed by plaintiffs while
improving Alameda avenue to deter
mine the liability of the city. The case
is still before the circuit court on a
demurrer to the complaint.
The City vs. 0. Wl Cottam was one
started in the police court on arrest of
defendant, for soliciting orders for
goods manufactured outside of the state,
The defendant pleaded guilty and ap
pealed to the circuit court, where it is
now pending, contending that the ordi
nance for violation of which he was ar
rested viz. 325S was void on the ground
that it attempted to regulate and re
strain interstate commerce, The eon
tentlon of defence Mr. Abercrombie be
lieves to be correct.
There are several other cases appealed
from the police court but the issue In
volved is not important and will not
affect any ordinance or provision of the
charter of the city. .
Mr. Abercrombie calls attention to the
many old and delapidated and worthless
structures that adorn our streets, and
which are a menace and danger to the
community. Section 7 of ordinance 1009
gives the committee on fire and water,
and the chief engineer of the fire de
partment the power to have such build
ings destroyed, ad some action on the
part of the committee might go a long
way towards beautifying the city, and
creating room and opportunity and rea
son for building many more and better
buildings.
