Attorneys of the state and defense in the Pettibone case are in conference today trying to agree upon a course acceptable to both sides, lhe defense has been unwilling up to this time to a'Tee to a postponement of the tria lset for next Tuesday unless bail is granted the prisoner, who remains a pa tient in the hospital, clearly in no physical condition to stand the ordeal of facing a jury. If the case were begun Tuesday it would surely lie interrupted by the prisoner's illness an operation being possible at any time he chooses to go upon the table. The state is unwill ing to have the trial proceed under the circumstances, and is also unwilling to let Pettibone go on bail. WOULD ENJOIN EIGHT-HOUR DAY, CINCINNATI, Oct. 8.
