The camp is laid ut nicely and during rest periods will add to the bora enjoyment. The officers mess in camp of Third Regiment, 0. X. ., at Fort Stevens, is in charge of H. D. Bomhoff of Wood burn. Colonel Walker and Lieutenant Ker foot, commander and adjutant of the Fort, respectively, have made inspec tions of the camps and drills and express themselves as well pleased at the show ing Captain Brosius, surgeon, Third Regi ment, reports the health of the boys excellent and he thinks that they will continue sa It is pleasant to note the' cheery, earnest manner iu which the instruc tions are given and received and the pleasant manner in which the regulars and guardsmen fraternize. SCHMITZ STILL DEFIANT. He Is Refused Release On Bail Cannot Visit Hii Attorney!. SAX FRANCISCO, July 9. Judge Dunne this morning refused to admit Mayor Schmitz to bail and denied him the privilege of visiting his attorneys. When Schmitz appeared in court he was self-possessed, as defiant and apparent ly as confident as he was yesterday. He came for the double purpose of ask ing for bail and answering the indict ments charging him with accepting bribe from the gas company and the T'nited Railroads. In the first he failed. The second was a formality and was carried through without incident. Attorney Drew offered his motions to set aside the indictments and to stay the proceedings. They are identical in terms with those filed in the other caes. Then he offered a stipulation that all the proceeding taken before Judge Law Tor in the gas, trolley and telephone eases should lie considered as made on behalf of Schmitz. This Attorney Johnson readily agreed to, but instead of filing a written compact he thought that the same ei.d could be accomplished by an oral stipulation which could lie incorporated in the record. Attorney Dretf con-entid. Johnson then moved that all the motion be submitted for decision, and Judge Dunne announced that a contin uance would be granted for one week for the purpose of enabling him to look over the record. After this had been agreed to. Attoney Fairall added to the other motions another, asking that the entire proceedings be stricken from the files. There was no objection and it wai inr-oiporatcd. Then came Schmitz' application for release on bail. '"If your Honor pleae," said Drew, "we also have an applica tion for release on bail." 'The defense s rved formal notice at mv office yesterday afternoon," replied District Attorney Langdon, "of their1 application and affidavits. I was absent and did not receive the notice until 10 minutes before 10 o'clock this morning. I have not had time, therefore, to make tho counter showing I desire. Schmiti left the court room witli his attorneys on his return journey to the county jail, where he will have to wait until the papers for his appeal are pre pared. SAS FRAXCISOO, July 9.-With a view of curing the anomalous situation in the municipal government resulting from the gr&ft prosecution it waa de cided toniuht by District Attnrner Langdon and associate to invite the commercial and later bodies of the city to send delegates to a convention which will be called in a few days for the purpose of choosing a Mayor who will fill out the unexpired term of Mayor Schmitz. Supervisor Boxton who was selected as acting Mayor will hold office until a Mayor is chosen. NOT SATISFACTORY. New Bill of Lading Does Not Meet Ap proval ot Bankers, XEW YORK, July !.-The new bill of lading, as agreed upon recently by the railroads and representatives of shippers, is not entirely satisfactory to bankers, it is announced here. In order to secure ,if possible, a change in the bill that ba already been agreed upon. a meeting of the special committee of the bill of lading committee of the American Bankeri' Association will be held in the near future to discuss the proposed measure and suggest what thev deem improvements in it. ASTORIA EXCURSION NOT GIVEN UP WRTLAXD. July 0. Because of the fact the northwest is filled with tourists and hotel accommodations arc taxed and lsideg many who desired to participate are unable to do so owing to business engagements, the excursion planned by Portland business men to 31 points on the Astoria & Columbia River anil the Northern Pacific railroads has been tem porarily held up. It wis planned to de part from the city July 24 and return Inly 28, and 40 per cent of the neces sary signatures weie secured for re-t-r-vations. It is stated positively the junket has not been abandoned but will be made later when a majority of those who de sire to visit towns with which the l!o-e City has commercial relations can ar range to take the necessary time away from their business. Secretary of the N'avy Metcalf deprecates the warlike aspect that has been given the order for the cruise of the great battleship sipiadron from the Atlantic to the Pa- cine Coast. The Secretary said last night that the proposed movement was that of a practice crul-e and that the fleet would not be kept in the Taclttc perma nently. He declared that the length of time that the lleet would remain on the western side of the continent hud not yet been decided. With considerable emphasis the Sec retary voiced hia opinion that the war like Interpretation that ba been made in connection with the fleets movement was not justified by the facta. In fact, the widely published reports suggest ing hostile preparation, teem to be a source of irritatiou for the head of the nan'. He said: "The fleet which will be moved from the Atlantic, to the Pacific this winter is coming to this side merely on a prac tice cruise. The fleet will constat of It) or more vessels, not more than 20, and its stay on this side will not be perma nent. Of course, the fleet will not come here, turn around and go right back again. How long it will ivrmiin In the Pacific will be determined at the proper tlma. There is no sound reason or excuse for all this talk by the public and through the presa of an attempt to overawe, the Japanese by a warklike naval display. I do not believe that the nwipaper are justified or right in o construing and coloring the cruise of the warships to the Pacific' "Every yeas the Atlantic fleet has been sent on a cruise, ,at year it was sent to Guantanamo. A terrillc wind strom her this evening resulted in tho death of one man and Injury to several persons. The financial loss will amount to a quarter of a million dol lars. The wind blew at a velocity of 80 miles an hour for 15 minutes and at (W miles an hour during the greater part of the storm. Tho surrounding country suffered considerable damage.
