COUNTY COURT HOLDS SESSION ACTION TO BE BROUGHT BY THE COUNTY AGAINST COUNTY COURT : TO TEST LEGALITY OF THE NEW LAW. A suit was ordered to be brought by Clatsop County against the county clerk and the county court. The matter was con sidered of sufficient importance to ne cessitate despatch and the district at torney being otherwise busy, it was or dared that J. H. Smith and A. M. Smith be instructed to prepare a case to tet the law. This action will be brought before Judge, the Hon. T. II. McBridc, and . will then be annealed to the Supreme Court. The cause of the mat ter is whether the new law which enacts that no copy of the roll be made but that the original be placed in the hands of the Sheriff, goe into effect imme. (1 lately and thereby affects the 1907 tax roll, or doe not go into effect till 1008. If the clerk makes a copy of the roll this year acting under the old law the tax would be invalidated, in case the new law is intended to go into effect at Once. Hence the necessity for immedi ate action in the matter. In the matter of the special road fund, the excess of $168.62 wa ordered to be transferred to the general fund. 1 3. Norem wa awarded the contract (o do repair work on road No. 99 at 20 cents per rod and was given till September 15th to complete the job.
