CHICAGO TERMINAL PROPERTY.
Efforts to Settle Controversy Given Up
Will Be Trashed Out In Court.
CHICAGO, May 10. The Record
Herald today says:
AU efforts to settle the contest for
possession of the Chicago Terminal
Railroad Company have been abandon
ed and the questions involved are to
be fought out In the courts. The
Baltimore & Ohio, which has bought
and retired the bonds of the terminal
company. Is preparing a petition ask.
tag; the United States court to modify
its order for the sale of the property
so that it will be sold subject to the
least of the petitioner.
ThJa action will be taken before
Judge Koblsatt within a few days and
objection will be offered both by tie
majority and by the minority stock
holders. The former are said to be the
Morgan interests which are trying to
secure the property free of the B.4 0.
leasts, so they can fulfill a contract to
turn ft over to James J. Hill and the
Burlington road'. The minority In
terests are preparing a cross tltlon
tn which it will be alleged that the
Baltimore & Ohio lease was procured
by fraud In connection with the old
lease of the St Louis, Peorlo &
Northern. The Baltimore & Ohio lease
was substituted for this, thereby re
llevfhg, the Harriman interests from
the payment of about 1150,000 annual
rental to the terminal
The minority stockholders will claim
that this wag an important factor in
promoting the failure of the company
and the court will be asked to cancel
the Baltimore & Ohio lease and ask
the receiver to bring suit against Har.
rlman, George Gould and others for a
large amount claimed to be due to the
terminal company. The fight will be
bitter and undoubtedly will keep the
terminal property in a receivership
several years and prevent the im
provement which was proposed if the
Morgan-Hill Interests secured control
f the terminal.
