Train No. 8 running as second No. 4 California lim ited on the Santa Fe, was ditched one mile west of Medway, a small block signal station IS miles east of Holly, last night, the cause being spreading rails. All of the coaches except the last Pullman turned over. The porter and baggageman were hurt, the latter having his right leg broken and a se vere gash Inflicted In bis side. An east-bound local brought back the pas aengers of the wrecked train to Holly for supper and lodging. A wrecking train was sent from La Junta to assist in clearing the track. Frank Hart WRIT OF HABEAS CORPUS. Albert Patrick Contemplating Move On Ground of Trickery, NEW YORK, May 7. The American today states that Albert T. Patrick, now serving a life sentence for the murder of Millionaire William Rice in 1900 Is contemplating asking for a writ of habeas corpus on the ground that he was tricked into with drawing his ap plication for an appeal to the United States Supreme Court while he was under death sentence . aryl accepting commutation to life Imprisonment from the late Governor HIgglns. The an nouncement is made on the authority of Mrs. Albert Patrick, wife of the prisoner, given in a long signed state ment which the American publishes. In this statement there are charges that the court, Jury and prosecutors were prejudiced against her husband and that a great sum of money was xpent to railroad the defendant to the electric chair. The regular meeting of the, city council was held last evening at C. F. Lester's resi dence. Those prcnt were Mayor Les ter, Councilman Grge W. Warren, Robert J. Abbott, J. Bosshart and Wil liam Hangman, City Auditor and Police Judge Stanton and City Attorney Eukln of Astoria. Bids for the erection of the proposed city Jail were presented. Ferguson A Houston, of Astoria, of fered to do the work for 1900 and Mr, Jacobs, of Atorla. sent In a bid of 11270. A motion was made And unanl mously carried that Ferguson A Hous ton's bid of 990 be accepted. On mo tion, It was agreed that a sidewalk be built from the west side of Main street to the east side of Hemlock street on the south side of Second street at the expense of the property hotdero with in the area above stated. Orders were made In the regular form on the city treasury for the payment of the fol lowing bills: Two months' salary to the city auditor and police Judge, $00: 5 to Mr. B." Van Duen, tnsuranco agent, for furnishing the bond of the city auditor, and IS cost of advertising for bids for the building of a city jail. Advices received here state that a Are at Hoca del Toro Panama Saturday, practically destroyed the town. Boca del Toro is a port on the Pacific, situated on an Island of the same name.
