The recent utterances of the President that the uniform of the army mid navy should not be discriminated asalnst any where In the country, and that to do so was a crime, have not seriously im pressed at least one court where this matter has been tested. The Incident has aroused great interest In army and navy circles, especially In view of the importance attached to this die turn of the President during the de bate In the Senate over the Browns ville affair. Interest In thfs matter, which the President first called to the attention of the country from Oyster Bay last summer, has been sharply re vived by an incident taking place at Plattsbu:?, New York. Sergeant William Htggins, of the Fifth infantry, stationed at the mili tary post there, went to a skatlr.g rink and was denied admittance because of his uniform. Bearing in mind the in junction of the President, Sergeant Higgins engaged a lawyer, caused the arrest of the proprietor of the skat ing rink and brought suit under the civil rights act of the state of New York, a drastic piece of legislation that is supposed to protect the per sonal rights of every citizen, regard less of race, color, etc. It was shown that the soldier had frequently been admitted when in civilian dress and all the indications pointed to a suc cessful prosecution of the case Here in Washington, among military men, there was general approval of the promptness with which the soldier act ed to resent the affront to the uniform he wore. Unfortunately, however, and here, is where the army officials are astonish ed, the Judge of the city court before which the case was brought, held there was no violation of the law, that the proprietor of the rink acted within his rights, and discharges him from cus tody. Owing to the increasing fre quency of incidents of this sort, war department officials have watched the outcome of this case with more than usual interest and it is needless to say ! The case will be of ficially reported to the department, but just what It can do to remedy mat ters Is not dear. If there Is any way thtoiiKh which coiiKiess could act there Is no doubt that the President would send a rinsing messaRe on the subject, but Congress Is powerless to interfere in such matters which good lawyers say come clearly within the power of the several states, it Is an ticipated now that there will be a general denial of the right of admis sion to men In uniform in places of amusement throimh'iui the country. legislation was suggested this week, the general principle of which un doubtedly will meet the approval of a great many of the people, but Its practicability will not be so readily admitted. Tor years there have been many who believed It would be a part of wisdom to dispose of the Philip pines and rid this country of the in cubus and its consequent burdens Im posed by the results of the Spanish war. Representative Clark of Florida has voiced this sentiment In a bill he has introduced which directs the Pres ident to sell these Islands to Japan or any other power that will pay what they erigiiully ens: and the subsequent expense entailed In retaining them. This government gave Spain, as a mere gratuity, the sum of $.'.ih)O.0ih at :he close of the war. It would re quire some very calculating work to reach any definite I lea as to what the islands have cos: the people of the United States since. Counting the cost of the army of pacification and of occupation and the funds expended In developing the Islands since, and In innumerable other ways, the grand total would run-up Into hundreds of millions of dollars. It is doubtful, public men say, if there Is a nation on earth that would find It convenient, even if It desired these Islands, to come anywhere near reimbursing this coun try for its outlay on account of Its recently acquired possessions In the nrient. so enormous Is the grand to tal of what they have cost. The In dications would seem to point to but one result that the United StaOes, through circumstances not of Its own seeking, assumed this burden and that no way can be found through which the burden can be thrown off. While many hope to see the Islands set adrift such a policy Is not that of the ad ministration, and the more American capital that ges into the Islands, th more remote will be the possibility of such a determination being reached. Awakening of interest In the organ ization and equipment of the National Guard Is almost universal in all the States, and Is callng for the very fav orable attention of Congress. In this connection the story of the American National Guard, from th" beginning will be of interest to all readers.
