BE IT ENACTED BY THE ELECT
ORS OF THE CITY OF ASTORIA:
That section US of said Charter of
the City of Astoria an Act of the le
gislative assembly of the State of Ore
gon, be and the same is rereby am.
mended so as to read as follows:
Section 143. The Commission shall
fill any vacancy that mny occur in
that body by death, resignation, re
moval from the city, or otherwise,!
by the appointment of a peron to be
a member therof who is a bona fide
resident and tax payer of the city:
and five members of the commission
shall constitutea Quorum for the pur
pose of. organization, as well as the
transaction of all other business.
The present commission shall hold
office tintill the first Monday In Janu
ary. 1909. and "until their successors
shall have been elected and have
qualified, and at the general election
to be held on the second Wednesday of
December, 1908 a commission consis
ting of nine members shall be elected,
two of which members shall be elected
from each ward, and one at large, one ;
member from each ward shall be elec
ted for the term of four years, and
one from each ward for the term of
eight years and the commissioner at
large shall be elected for the term of
eight years, and the successors of each
shall be elected for the full term of
eight years, so that one member of the
water commission from each ward
shall be elected every four yars. and
the term of office shall be eight years
and until their successors are elected
and have qualified, and any person

for the remainder of the unexpired
term.
This amendment shall take effect
and be in force on the first Monday

have declared their Intention to be

form contract or any other work for

Fourth. Every contract for work to
be performed for the city must pro
vide that in the perftormance of the
contract, eight hours shall be the
mail mom hours of labor on any cal
endar days. Any contract for work
to be performed for the City whlca
does not comply with the provisions
of this section shall be null and void,
and any officer who shall sign the
same shall be rullty of misfeasance
and upon proof of such misfeasance,
shall be removed from office.
Fifth. Any contractor who shall
undertake any contract for the con
struction of any public work s.iall be
required to give bond, witn two or
more sureties, in a sum? to oe nxea
by ordinance, conditional that such
contractor will rav all persons per
forming labor or furnishing material
In executing the contract upon which
anv such person furnishing labor or
material shall have a right to bring
suit In the name of the City of Asto
ria, which suit shall be prosecuted to
final Judgment as a suit In equity for
the benefit of all persons Interested.

MENT TO CITY CHARTER.

mendment to the Charter of the City
of Astoria shall be submitted to the
legal electors of the City of Astoria for
their approval or relectlon, at the
general election to be held on the 12th
?av of December, A. D.. 1906, and
In respect to
the respective estates and Interest of
such owners, lessees, and other per
sons interested in any lands, tene
ments hereditaments, and premises,
and shall report such assessment to
the next session nf the Council. The
respective sums so assessed by said
viewers on the owners, lessees, or oth
er persons interested in thu lands ten-
comprise all
of Astoria
lying et of the center line of Fifth
Street, extended a sulliclept distance
North and South to Intersect the
North and South lines nf the City of
Astoria. The second ward shall com
prise all that portion of the City of
Astoria lying between the Feist line
of the First ward and Hie center line
of Fourteenth Street, extending a suf
ficient (Usance North and -'outh to
Intersect the North and South lines
of the City of Astoria. 'Ihe Third
ward shall embrace all that nortion of
the City of Astoria lying between the
Kast line of the Second ward and the
center line of Thirty-fifth Street, ex
tended a sufficient distance North
and South to intersect the North and
South lines of the City of Astoria,
and the Fourth ward shall comprise
all that portion of the City of Asto
ria lying East of the Fast boundary
of the Third Ward; and the Common
Council, by Ordinance, may create
additional wards or change the boun
daries of those established, and when
it creates an additional ward the
Council may appoint, two Councllmen
from such ward to hold until the next
election, at which election one Coun
cilman from each of said additional
wards shall be elected for the term
of two years and one for the terrn of
four years and the successors of each
shall be elected for the term of four
years, so that one Councilman from
each ward shall be elected every two
years.
Section 5. Kach ward now estab
lished and any additional ward that
may hereafter be establish Is entitled
lo elect two members of the Common
Council.
