Section 40, -The Mayor is the exe
cutive of the Municipal Corporation
and as such must exercise a careful
supervision! ouer its general affairs
and subordinate officers, and see that
the laws relating to the City, and the
ordinances and regulations of the
Council are enforced and, in order to
enable the Mayor to enforce all the
laws and ordinances of the City, he
Bhall have the power to suspend from
service anv officer or employee of the
Police Force, Fire Department, Street
Denartment and Surveyors Depart
ment of the City, who shall refuse to
enforce the laws and ordinances of
the City, pending an investigation
bv the Common Council of -he City
of Astoria, and shall forthwith re
port such suspension to the Common
Council, and unless such officer is ex
onerated by a majority vote of the
Council within thirty days after the
Mayor shall have filed notice of his
susrension with the City Auditor, the
offlce of such negligent official shall
be deemed vacant. It is his duty an
nually at the regular meeting of tlie
Council, appointed by this Act, to
communicate by message to the Coun
cil, a general statement of the condi
tion of affairs of the Municipal Cor
poration, and to recommend the adop
tion nf such measures as he mav deem
expedient and proper, and to make
such special communication to the
Council from time to time as he may
think proper and useful.
This amendment shall take effect

in January, 1907.
