Questions Involving the police pow era of a state will probably soon be de termined by the supreme court of the United States, In New York recently nassed upon the legality of the ten hour a day law for bankers, which was In effect, forbid ding bakers to work more than 60 hours In a week. Unless it was clear, the court decided, that restrictions of this sort were intended to protect life, health or morals, they could not be allowed to suspend or override the constitutional rights of the cltixens. Conditions in - the bakers' trade were declared not to warrant the use made of the state's police power, Inasmuch aa no peril to life, health or morals had been shown sufficient to Justify nrhitrarv limitation of a baker's . ! working hours. In view of this decision .declared by Justice Harlan to be an exceptionally Important and far reaching one, an attempt is now being made in Indiana to apply the state's general police powers is certain to attract much In terest The Indiana legislature at Its last session passed a stringent anti ctgarette law! This measure made it illegal to manufacture, sell or give away cigarettes; but It even went fur ther than that, and made it a finable offense to smoke a cigarette or have In one's possession either a cigarette o- a cigarette wrapper. The law was approved by the governor and has now gone into effect Last week the leader of an orchestra in Kichmond Ind was arrested for smoking a cigarette and was fined J23. A citizen of An derson was arrested on the same day and fined 135 for having cigarette pa per In his possession. Appeals have been taken in both cases and the state courts will have to decide whether the law as it stands Is valid. Eventually, If the plaintiffs lose, an appeal will he taken to the federal supreme court. Oregon "has no law prohibiting the smoking of cigarettes, although an ef- the legislature to pass one. There is no question but that smok ing cigarettes is a filthy and disgust ing habit, and tf moral suasion will not deter young men from Indulging In the habit we see no reason why a law should not be passed to compel a man to be decent as well as to be moral. A law of tMs kind would be beneficial in Astoria. An effort was maJe at one time to organise a club of young ladles who would refuse to associate with a young man that smoked cigarettes, but It didn't pan out. It left practically no young men for a young laJy to go tn tho theater with or enjoy an Ice cream, and they couldnt stand to lose these pleasure There are very few young men that would associate with a young girl that smoked cigarettes, but as a rule, women put up with more faults and Indiscretions from young men and even husbands, that hus bands would tolerate ia their wives.
