Susman Will
: t Make Appeal
r . v 1 '
Refuses to Pay Fine Imposed in
Justice's Court Drove an
' , . - Old Crippled Horse. .
What gave promise at first of a brief
fclving; of testimony, a swift conviction
nd the imposing of a fine, developed
jfpterday In a long drawn out trial
that occupied the attention of the jus
tice's court from , V fu m. until 4:3w
b'clock in the afternoon. And the end
iR .notyet, for the dissatisfied defend
ant vmvs that he will make appeal. In
such, event, the State vs. Marcus Suh
ian will appear upon the dockets of
the circuit court.
'.Tiilr; Buwian'waa arrested a few days
jifo, the charg being cruelty to an oai
' nial. The alleged cruelty rested in the
tact that Mr. Susman had been drlV1
lng about the streets a horse that gave
every appearance of being utterly unfit
for work. He is old and sfemlnly crip
pled in every Joint, and when being
(Uiven 'staggers along as if each step
would surely be his last. So when Main-
Suprenant filod complaint again.Mt
fcu.iman, none expressed surprise. At
t':is om'i the defendant determined
to fixht the case and retained A. M.
Smith to his defense. The case was
called at 10 a. m. and with the excep
tion of a brief respite at noon, contin
ued Until late in the afternoon. '
Besides the taking of testimony of
several witnesses, the horse was led up
to the 'door of the court room in the
afternoon and was critically inspected
by the jury. The animal looked a fit
subject for a glue faftory, but never a
draft horse; so the jury was not slow
in bringing In a verdict of guilty as
charged, when the case was finally
turned over to them. The court im
posed a flne of 25 and costs, which sum
wus not collected, the defendant pre
feiTing to make appeal. It Is possible,
however, that this plan may be aban
doned, as Busman's friends are trying
to make It clear to him that It would
be better for him if lie would pay up
' and be 'good.
