It reverses ' the decision of the lower court and or ! dera the case remanded back for a new - trial. The case-Is an Interesting one and grew out of the fact that a broker :who handled salmon for the Alaska. Fishermen's Packing Company made a contract with Rdd, Murdock & Co. for the sale of Puget sound sockeye sal mon. The contract was subject to con firmation by the local company, which refused to confirm, 'it agreed, how ever, to submit samples of red Alaska, which could be accepted m rejected at the pleasure of Reld, Murdock & Co., the price, if accepted, to be $1 per .dozen. In the event of rejection the matter was to be considered as settled. Samples of Alaska reds were submitted accordingly, whereupon Reld, Murdock ft Co. asked for fancy Puget sound " sockeye fish. ' The home company did ; not (pack this variety, never agreed to deliver them, and suit was brought to recover the difference between the maf: ket price of the two grades of salmon, A consignment of salmon from the Alaska Fishermen was attached by Ueld, Murdock & Co. in Chicago, but bonds were furnished and the goods re leased. Suit'was then brought In the Illinois courts, and resulted In a vic tory for the Astoria corporation. Then Reld, Murdock & Co. brought suit here, with the same result.
