The governor of Montana Is holding up the requisition of the governor of Mis souri for a fugitive from Justice and the governor of Nevada has refused to honor, except on condition, the requi sition of the governor of California for the return of two escaped convicts. The exouse offered by the Montana governor is the alleged grounds of fear of there being back of the requisition a political conspiracy against the accus ed. The only reason assigned by the governor of Nevada for holding on to the California convicts is the matter of reward. In neither case Is It alleged that there are Irregularities on the part of the demanding governors and it is to he presumed that they compiled strict ly with the United States statues gov erning inter-state extradition. It must also be presumed the governors of Mon tana and Nevada have decided to Ig nore the custom and law, as far as they dare, governing In extradition matters. Iiaving so decided they must take the consequences. To say nothing of the disturbance ' of the comity between the states concerned., it is a Vf-ry dangerous precedent. The crimi nal cannot be punished in the state where found for crime committed In another state and to thos who refuse to deliver up he will ny for the'assur ftnee of immunity from punishment. The law officers of the state from which the fugitive fled are better qualified to Judge of the deserts of the offender than the governor of the state in which he has taken refuge. It Is not the governor's province to inquire Into the conditions existing In the demand ing state. The requisition itself shows that a Jury of twelve men have return ed an' Indictment or that a complaint has been sworn out before a magis trate. It shows that the district attor ney has investigated and endorsed the application and that the governor of the demanding state has certified to the authenticity of the proceedings. Fur ther than to pass upon the regularity of the demand a governor has no authority to go. The fugitive held In Montana may belong to a respectable family of Missouri boodlers, but the governor of Montana has no warrant for going beyond the requisition papers to make such inquiries. California may be poor pay but it is not within the province of the governor of Nevada to pass upon the former state's dispo sition to pay or shirk debts In consid erlng the application for an extradition warrant. Montana and Nevada have made the bid for hunted criminals to come with in their borders 'or a haven of safety and they no doubt will get them. Mr. Charles Wirkkala, the new pro prietor of The Louvre, will have a grand opening on next Saturday night, Snpt. 19, 1903, to wM'.'h the public are invited. Mr. Wirkkala is well known In Astoria and he wishes to see old friends and new ones on this occasion.
