Controversy Over Substitution of Name
for That of Dead Admtral,v
'WASHINGTON', Oct. 28, There was
a brief reminder of the Sumpson
Srhlcy controversy In the supreme
, court of the United States when the
ciuw of the United State vs. w. T.
Sampson, rear-admiral et at. was call
ed for argument. It Involves dlstrtbu
tlon of prise money because of the
capture of the Spanish cruiser Infanta
Maria Theresa In the battle of San
tlanv. '; ,
Chief 'Justice Puller suggested the
necessity of substituting some other
name for that of Admiral Sampson In
view of the Admiral's death. , ' m
Assistant Attorney-General Hoyt,
for the government, responded that the
parties to the controversy had sup
posed that the court might make a
suggestion later in the vase and that
for the present the argument could
continue under the present title.
Chief Justice Fuller manifested a dis
position to demur to this suggestion,
urging that the name of, some other
tfastt could b used "that," he said,
"of Admiral Schley or some one else."
The name of Admiral Schley did not
appear to meet the approval of the At
torneys present representing the naval
officers. One of them, James Hayden,
responded that there would be some
dIflk-uUy about making substitution.
"If," he said, "there is to be a sub
stitution there remains but one man
who was an officer of the fleet and that
is Captain Chaiwick, who was Admiral
Sampson's crlef of staff. Admiral
Schley's duties were limited to the
command of a division of the fleet."
"I had thought it possible," respond
ed the chief Justice, "that it might be
a question of rank or title."

plied: "If Admiral Sampson had not been
present and In command there, Admiral
Schley would have lwep, in command

The chief justice seemed interested
over the turn the case had taken. His
hands were raised, as was his voice,
slightly, when he asked: "Is that
point Involved in this case?" He was
assured that it was not and counsel
took the matter of naming a new liti
gant under advisement.

NEW YORK. Ocfci 28. The Herald
prints a dispatch from Trenton, N. J.,
in which ex-President Cleveland is
quoted as saying:
"1 feel very much interested In my
party this year, but do not want to
take an active and prominent part in
the struggle. I consented with reluc
tance to make a speech at Morristown
on next Thursday, because the cir
cumstances were represented to me as
being exceptional, and It was thought
that I could do some good.
"But the fact that I consented has
gone out and brought down on me an
avalanche of applications for me to
make speeches or to write letters or
otherwise to get Into the fight This
I cannot do. There are other demo
crats who are coming forward and I
am quit content to stay in retirement
and enjoy the repose of home life.
"It is generally felt," Mr. Cleveland
added, "that the democratic party
stands on solid ground this year In
unequivocally declaring for a revision

Scoffy has filed a suit In the United
States court to restrain Frank Hen-
nessy, manager of the "Liberty Belles"
company, now playing at the Califor
nia theater, from producing a portion
of the play, which he claims la an In
fringement on a play entitled "Under
he Sphynx," the copyright e which!
how In his possession, having been
made over to him October 23 last by
Mra Edith Cook of this city, who !s
the writer and had the same copyright
ed on April 7, 1S97. The case will be
tried before Judge Morrow next Mon

nite action has been taken toward ar
ranging a reception for General V. R.
Chaffee, when he arrives In this city
the last of this week or the first of

commercial associations of the city
have constituted themselves Into a
committee to wait upon the general
and tender him a general reception in
the rooms of the chamber of com
merce. He will also be invited to be
