The other man escaped uninjured. It is under- derstood Mr. Curtl will sue the city for 1100,000.60 damages, the 1100,000 be ing for the Indignity suffered by him and the BO cents for the drinks. John 8. Lament, aa president of Portland Aerie, No. 4, Fraternal Or der of Eagles, has brought suit against the Fidelity & Deposit Com pany, of Maryland, to recover the sum of 12083.25, claimed to be due on the bond ot the late Charles S. Walte, who was up to the time of his death treasurer of the lodge, and waa short that amount It Is claimed that the surety oom pan y refuses to make good this sum, and action Is brought to recover. The complaint alleges that Charles 8. 'Walts was treasurer of the lodge from January 7, 1901, until November 20, 1901, the dime of his death, and that In pursuance with the regulations of Hhe order, he gave a bond With the defendant company In the aum of t40M. It la said that from July to . October tie received .In cash the um of 1130.56, which he failed to turn Into the treasury, and that he also had In hi possession county war rants, the full value of which to th plaintiff 1 unknown, but from mem orandum left It la believed they mounted to tlS2., which would make a total of $2053.25, shortage to the lodge. For some time past the local Cham ber of Commerce has been making an effort, with the assistance of General Agent Mayo, of the A. ft C. It It, to "have Astoria included In the rolnt to which ett!er rate are extended. The following from the' :regonliu of yesterday Indicate that the effort may prove successful: "Citizens of Astoria have asked' Uie rail and water line between that city and Portland to arrange for the application of the 2B sutlers' rate through to Lower Columbia river points. The matter has been taken 'up with tonnectlona and there is every prospect that the application will be granted. It Is not yet known whether the Northern lines will object to applying th through rates to point on the Lower Colum bia, as they do to pointa south of Portland. The Northern Pacific could not decline to apply the rates to aH stations between Portland and Qoble, but whether. U will put them in to Astoria Is not yet settled." The Ore gonlan adds that he Northern fine have declined to extend rates to olot south of Portland. K. Llbke, C Ebaon. W, J. Ingalls. J. N. Heckard and W. J. Dyer, repre senting the people living along the Lewis and Clark river, were before the county court yesterday in tb In terest of their propoaed new road. The delegation urged the county court to make an order providing for pay- ment of aalarle of the sawyer and engineer of the county sawmill out of the general fund, and not out of the fund aet aside for district No. 5, in which the road I to be built They represented that they had collected about t00 to assist in the work, and that at least tlOOO would be subscribed. In view of rhla financial sacrifice, they thought the county at large Should donate the service of (he sawyer and engineer. Tha court discussed the matter at some length and finally de cided to make an appropriation of 1200 for the purpoee. The money will be taken from the general road fund, whloli is created from small amounts derived from different sources, such a unexpected taxea .remnant of oth er funds, etc. Whether or not the county sawmill will be removed to the Lewis and Clark I a question. Judge Ory favors using the mill on the Lewis and Clark road, but Com missioner Young oppose the plan. Mr. Young desires that - the sewmlll remain where It 4s, so operations on the Nehalem road ' will not be Inter fered with, and suggest that tiie Heckard mill on the Lewis and Clark be utilised for the road proposed. This matter will shortly be settled- About 20 person registered yester day at the office of County Clerk Wherlty. The first voter to register this year waa O. O. Moen, who re sorted to a tittle sharp practice to gain the distinction. Mr. Moen and Deputy Sheriff It O. Praet entered the clerk's offloe together Wednesday morning, and. learning that the regta t ration books bad Just been opened, decided to flip a coin to aee who should first register. Mr, Prael won the toss, but he was busy for a few moments afterward and In the meantime Mr. Moen registered. Mr. Prael'a name was the second to go on the books. The rolls show that there are many voters well along in years, and com paratively few under SO. The oldest person thu far registered Is Robert 8. MrBvvan. who haa lived 88 years, and will undoubtedly pass the 100 mark. Mr. McEwan is a native of Nova Scotia, and Is now residing at the corner of Bond and Fifth streets. A. Montgomery, aged 80, Is the second oldest voter to register. Mr. McEwan Is remarkably well preserved and till possesses keen mental faculties. He has been arrested Just once dur ing his long life, and related the cir cumstances In Mr. Wherlty'a office a few days ago. He was over 80 year of age when the strong arm of the law descended on him, and hla offense waa the firing of a gun within the city limits. A flock of wild geese waa flying over the city and Mr. McEwan repaired hurriedly to the house and secured his . rifle. He fired Into the flock and killed a goose., The matter was reported to the authorities and the aged marksman was arrested and fined $5. The fine waa remitted, how ever, the court taking the view that a man over 80 who could kill a goose was entitled to a few extra privileges. SUBSCRIPTIONS FOR ROAD. Ingalls, of the Lewis and Clark committee, reported last even ing that a total of $770 had been sub-' cribed to assist lu planking the pro posed highway.
