Frequent showers have ocurred In the lower Willamette valley and coast counties, while In Southern and Eastern Oregon fair weather haa prevailed, with the ex ception of Sunday, when light rain fell. In Western Oregon the maximum, or day. temperatures ranged between W degree and 78 degree), and the mln Imum. or night, temperature between 40 degrees and M degrees. In Eastern Oregon these variation were for day temperatures between 42 degrees and for night temperature between 44 de grees and B4 degrees. Light frost occurred In Eastern Ore gon on the 19th, but no damage to vege- atlon resulted. The rains have been of great benefit to pas to re and gardens, and were Just what were needed to fit the land for fall plowing. More rain Is necessary, however, before plowing and seeding can be actively pushed. 8ome fall wheat haa already been sown on summer fallow In the Wllam- ette and Columbia river valleys, and In OTie localities It haa appeared above the ground. The first witness called by the pros ecution was Mr. Copeland, of the Bee Hive, who stated the amount and kind of good that waa stolen from the store nd Identified the recovered property a a portion of It. Court was then ad ourned till aft?rnon. The first wltnes called In the after noon wa M. S. Copeland, of the Bee Hive,, who Identified Davl at one of the men who came into the store the day preceding the robbery and purchas ed a valise which waa recovered with the other property. Detective Jack Kerrigan of Portland was then called and told of the arrest of the two men, Davl and Sullivan, hy Detective Snow and himself In 1'ortlond, and of the offer of the two men to give them all the founder to let them go. Detective FrnV flnow was next call ed and corroborated the testimony of Krrlgan. The next witness vaa the Japanese merchant. N. Nakalani. who testified that he purchased a quantity of the goods from the two men, Davis and Fulllvan, and that they told him they had a store In Astoria and that they were selling tin good very cheap. He Ud he purchased good from them two different times and afterward Identified the men as the ones he se cured the goods from. Court was th-n ad ourned till 7:S0 p. m.. when It mH and Sheriff Llnvllle was called. The sheriff gave some of the eonversatlona he had had with the prisoner and also told some of the con llk-tlna statements made by Sullivan leitardinr Davis' connection with the aSTalr. Thlt closed the list of witnesses for the prosecutlor and Captain Reeves, mate of the iiner Lurllne was ca'I ed for the defendant. He stated that en the morning of the robbery which was the first trip of the Lurllne. but four passengers came aboard and but two of them for Portland, and describ ed the luggage they had with them which answered partially to that of the stolen property and said that the twe men were much unlike in appear ance, the two men oow on trial. Next Mrs. Mitchell was called and testified that a pair of shoe were giv en her by one of the men. Arthur or Morrel! on the day after the robbery, answering to the description of the "hoes taken from the Bee Hive. The defense then railed for John Sul llvan and a little diversion waa caused by the bailiff nolng to the door and calling nut "John Sullivan." Some one Informed him that Sullivan was In tail and a deputy was sent for him. The witness took the stand and when ask edt gave his name as John Miller, which ne said was hit riarht name. He testi fied at length upon the meeting with the ether two men who he said furnished him the goods, telling him the goods were smuggled goods and that he took them to the room occupied by his friend, the prisoner, and asked him to helo him sell them. That he did so. and went with him to a number of places to sell the goods. He also swore pmitlvely that defendant had never been In Astoria, but admitted that he had been; claiming that he waa here the tenth of August, looking for work. He waa followed by the defendant, who wa sworn and testified along; much the same line at taken by Sullivan or Miner. s he gave hla name. Astoria. Or, bert Davis, for larceny, came up for trial. Some difficulty was experienced In getlng a jury but this was finally accomplished and the case proceeded. Davis Is on trial for burglarizing the Bee Hive store on the morning of Au gust 23rd, when money and goods to the amount of nearly 1400 were taken. The man Davis and another man who gave his name as John Sullivan, were arrested the Sunday night following the robbery In Portland by Detectives Frank Snow and Jack Kerrigan and a quantity of dress goods and other material .that was afterward Identified as a portion pt the stolen property In their possession. Before the grand Jury lost week the men pleaded not guilty to the charge and their trials were set for separate days this week. The Jury selected tor the trial of this case are as follows: E. M. Houghton, John Lewis. H. D. Thing, George A. Nelson, Phil Condlt, W. O. Prescott, Robert M. Lowe, B. B. Kunxler, Geo. McFarlane. R. R. Cole. A. E. Melnard and J. R. Wherry. The line of defense taken up by Mr. Wlnton. the attorney for the defend ant. Is to the effect that Davis, had received the goods from Sullivan, who had In turn received them from two men whom he named as Alex. Arthur and Mr. Morrell, and that defendant received them as smuggled goods, and as such took them to a Japanese by the name of Nakatant and told a portion of them.
