Fisher Bros., 20.50; Foard A Btokes Company, 14.10: Astoria Box Company $78.21. s Cinltns recommended by the fire and water committee for payment follows: Astoria Box Company $5; Conn Prug-Comi-any, 2.50; Fisher Bros., 21 cents; Llnenwchcr, 60 cents; A. V. Allen, J2.05; Fonrd & Blokes Company, 119.72; West Shore Mills Company, S. Tho clnlins recommended by all these commltteea were ordered paid. City Attorney Allen red a com munication relative to the payment to L. Leback of a wa.rra.nt against the special road fund. Mr. Allen's opinion was that there being- no money In the fun I It devolved upon the council to paas an ordinance authorizing the pay ment of the warrant out of the general fund. Tile report was adopted. City Attortvey Allen then made a statement to the effect that he had beer, naked for an opinion In regard to opening up the road around Smiths point and a to whether or not It Is a pnbllo highway. Mr. Allen said he found tl'.st the road was laid oM several years ago by thd county court; lha right of way being donated to the city by the late Colonel Taylor. After ward, a petition waa filed by th I'etl- Inaular Land ami Truat Company for lh vacation of the mud, which waa alifned by K. A. Taylor aa pre.ld. nt of the company As th p-titlon did not comply with the law Mr. Allen stated It to be his opinion that the roud Is still a county road and a pub llu highway, Tho county court, Mr, Allen thinks, had no Jurisdiction under the vni.atlon preceding, and ahould not have declared the roud vacated. Tj make thine proceedings legal, Mr. Allen said, required a petition slgnad by 13 persons. The city attorney further advised the council that the county court ran In slitt'te proceedings to remove obstruc tions from a public highway, but In this Inalaure the county muat b the flrt party. A nutHlim was read from I., fobeck through J. F. Hamilton, relative to a warrant presented to City Treaaiiaer Oirry some time ago covering a dis crepancy of Intereat aa figured by the former tlty trea.usor and Mr. Ham ilton. The amount of the warrant Is IlV and It Is dated December mi. A partial payment was made on the war rant about two yeara after its dute. Tho amount of Interest In dl.pute was little over 120, Treasurer Carney figuring on the uaual way of pay ing warranta. The disputed sum arose from being figured by Mr. Hamilton at compound Intereat The committee on ways and means, to whom the mut ter was referred at the time, upheld the course of the city treasurer. City Atorney Allen, said the law waa on Mr. Hamilton's side, while custom and commercial law upheld the course of Treaaurer Carney. Mr. Carney, who waa preaent, waa asked for an explanation and said that If It was a personal matter he would like to so il tested In court. In any cum-, he said, he would require poaitlve In structions from rhe council before h Would pay the difference. No action was taken In the matter by the coun cil. A petition was read fnun Sui-erlnten- dent of Htrerta Kearney stating lhat a portion of Franklin avenue mar the; Adair line waa In bud condition and: should be repaired. And that nlno! Ninth street from Aslor to Bond need- 1 nl attention. The communication was. on motion, placed on file. Some of the councllmen were of the opinion that Superintendent Kearney Should eerve notices on the property owners to repair the streets In qu-atlon and If such notice were 'not com piled with In 24 hours, that he should bt Instructed to go aheud with the work and file a lien an the property for the coat of the Improvement. An ordinance waa Introduced for thi Improvement of Seventeenth street from the south side of Franklin avenue to tho uoith side of Irving avenue, and passed the second reading. A motion to suspend the rule and pans th ordinance waa lost, Parker and Welch voting no. A resolution was Introduced to the effect that the city attorney be asked whether It la poaalblc to exempt old buildings from the ordinance prohib iting shingle roofs from being put on building within the Ore limits of the city. Mayor Bergman suggested that the ordinance be repealed, aa It was the only way to remedy the confus ion that haa arisen. Mr. Welch ob jected to this course and said property holders should be compelled to obey the ordinance. After further dlncus slon the resolution was, on motion, laid on the table, A resolution waa Introduced that the chief of police be Instructed to have all license numbers on wagons and vehicles displayed. The motion was not put. there being no second. A motion that the mayor appoint a committee of three for the purchase of 'a 'rock crusher for the city waa not put, there being no second. A resolution waa Introduced that the grades. on all streets from the harbor line to Summit avenue be altered so as to make the grades from' north to south four feet higher and that the city surveyor and city attorney be In structed to secure figures for the cost of raising the same. The resolution created a good deal of discussion, some of the councllmen expressing the opin ion that such Improvement would put the pity ' ten 'years ahead of its time. The resolution met with no sec. ond, and, therefore, was not put. After requisitions were granted for the Are department the council ad Inurned. :Pears?
