Under the acts of congress of June 3, 1878, and March 3, 1891, resi dents of the state of Oregon are per mitted to take timber free of charge from the vacant, unreserved, non mineral public lands of the state, not within national forests, for their own uses for building, agricultural, min ing or other domestic purposes, 4bnt not for barter or sale, under rules and regulations prescribed by the sec retary of the Interior. Copies of these rules and regulations' may be secured by application to the Chief of Field Division, General Land Of fice, 310 Custom House, Portland, Ore. It has been held, however, that the lands embraced within the Oregon & California railroad grant, title to which has been revested In the gov ernment, are not vacant, unreserved non-mineral public lands within the meaning of the above acts of con gress, and that there is no authority for the granting of permission to cut or remove timber from these lands. Therefore, any person cutting or re moving timber from said Oregon & California railroad grant lands must be considered a trespasser, and sub ject to prosecution under the laws of the United States.
