Xotice is hereby given that, pur suant to a resolution of the Common Council of the city of Ashland, Ore gon, duly adopted the 2nd day of June, 1914, and approved by the Mayor the 3rd day of June, 1914, the following proposed amendment to the Charter of the city of Ashland will be submitted to the legal voters of the city of Ashland, for their approv al or rejection, at a special city elec tion, to be held June 23, 1914, to-wit: AX ACT to amend an act entitled "An Act to Amend an Act entitled 'An Act to incorporate the city of Ashland, in Jackson county, Oregon, and define the power thereof,' " filed in the office of the Secretary of State, Octo ber 14th, 1898, and the amendment of said Act as adopted at the annual city election held on December 15th, 1908, and proclaimed by the Mayor on December 17th, 1908. The people of the city of Ashland, Oregon, do enact as follows: . Section 1. That the act entitled "An Act to amend an act entitled an Act to incorporate the city of Ash land, in Jackson county, Oregon, and define the power thereof," filed in the office of the Secretary of State, October 14thi 1898, and the amend ment of said Act, as adopted at the annual citv election, held on Decem- l,Pr ir.tli. 190N. and nrni-lainied bv the Mayor on December 17th, 1908, be and the same is hereby amended by adding Article XX thereto, which shall read as follows: ARTICLE XX. Section 1. A board is hereby cre ated which shall be known and desig nated as the Springs Water Commis sion of the city of Ashland, which shall consiwt of three citizens, each a resident householder and legal voter of the said city of Ashland. Section 2. The first Commission ers to be elected at the same election at which this amendment is adopted shall be elected as follows: R. A. Mlnkler, whose term of office shall expire the 1st day of January, 1915; J. P. Dodge, whose term of of fice shall expire the first day of Janu ary, 1916; Bert R. Greer, whose term of office shall expire the 1st day of January, 1917, each commissioner to serve until his successor is elected 'and Qualified: and the commissioner elected for the long trm shall be the I chairman during hie term of office. One Commissioner shall be elected at each annual city election fof a three-year term, and take office on the 1st day of the following Janu ary, and the Commissioner oldest in service on the Commission shall be Its chairman. Section 3. The first commissioners elected shall meet immediately after qualifying and elect a secretary whose duties and term of office shall be such as may be provided by the com mission and thereafter at the first meeting held In each year said com missioners shall elect their secretary. They may also adopt rules and regu lations for their government and for the carrying into effect the objects and purposes of the creation of shld Springs Water Commission. Section 4. The said Springs Water Commission shall have full control and management of the auxiliary wa ter plant, and Is hereby given power to construct. Install and maintain the same and do all things in and about the premises necessary for its com plete construction, installation and maintenance; to enter upon and use for such purposes the public grounds, streets, nlleys, parks and ways of the said city of Ashland in so far as necessary for such construction, In stallation and operation, but when bo used the same shall be restored by said commission to as good condition as formerly existed before such use Any and all expenses occasioned by sucn restoration, and all expenses wnicn may tie incurred by the city In connection with said auxiliary water system, either In the matter of hold Ing election or otherwise, shall be borne by and paid from the auxiliary water plant fund to be created and maintained as hereinafter provided. section 6. All contracts entered Into by the Springs Water Commis sion for material, construction, labor, supplies and for every other purpose in carrying out the object of its cre ation shall be made in writing under the seal of the Commission, signed bv the Chairman and Secretary there of in four duplicates, one of which shall be filed with the City Treas urer, one with the City Council, one retained by the Commission and one by the contractor; and no wok under said contract shall be proceeded with until the said duplicate sontvacts have been so filed. Section 7. The council may exact a good and sufficient bond to be en tered into by the commissioners in such sum as in the judgment of the council may be necessary, conditioned upon the faithful performance of the commissioners' duties according to the tenor of this amendment, and that they will honestly and promptly ac count for all funds passing into their hands, provided the expenses' of Bald bond shall be paid out of the funds herein appropriated. The commissioners shall enter Into no contract or issue any voucher in excess of the sum hereby appropri ated for the construction of an auxil iary water system, and no contract or other obligation, together with the total of all contracts and obligations previously entered Into, shall exceed the amount of funds herein appropri ated for the purpose, it being the in tent hereof to keep the expenditures made by said commission entirely within the eaid appropriation, and any contracts entered into or any voucher issued therefor in excess of said appropriation shall not be a charge against said fnnd or the city of Ashland, but may be recovered upon the bond of said commissioners by proper civil procedure. All contracts shall be made in the name of the city of Ashland and all contractors shall be required to fur nish good and sufficient surety bonds, conditioned upon the faithful per formance of their contracts. Payments to contractors may be made from time to time as the work progresses on the estimates, but at no time shall such payments exceed the work actually performed, and in no case shall more than 85 per cent of the contract price be paid until the work is fully completed and accepted. Section 8. During the construction of eaid plant the said Springs Water Commission shall file with tne City Council OP the first Tuesday of each month thereof an. Itemized statement of all expenditures made bv the com mission during the preceding month, Showing for wfcat the expenditure was madi and Rhi'H it'-'lll thereof, the total ftiiluuht and to whom paid, which Itemized statement shall be published by the commission for the information of the public; and when the construction of said plant Is com pleted the Springs Water Commission shall make a detailed statement of all amounts expended In said construc tion and of all properties ac quired for said purpose, for the In formation of the Council and the pub lic, and such statement shall be spread upon the permanent records of the city; and thereafter monthly reports shall be madev Section 9. At the time for making the tax levy for general city purpose? in ench year, the said commission shall cause a careful estimate to be made of the money required for aux iliary water purposes for the ensuing year, and file the same with the City Recorder, whereupon the City Coun cil shall include in the said geneir.l levy not to exceed one mill on the dollar of the taxable property of the city to meet the necessary require ments, which, when collected, shall be deposited with the city' treasurer to be placed to the credit of the auxiliary water plant fund and subject to tne order of said commission. Section 10. WATCH FOK OVKRVvT!-: JXSIIHOIS ORPHAN'S It is reported that the committee opposed to the bonds have had dodg ers printed and will distribute them generally about the city tonight. The Tidings has no information as to what the bills contain. We heard they were printed several days ago and will not be circulated until too late to be answered. If it is true they are to be circulated too late to be answered we will only remark that is a suspicious circumstance, and will no doubt cast , reflection upon the truthfulness of the state ments made therein. The springs committee has had nothing to hide. Its last meeting was held Saturday night in order to give ample time for the opposition to answer what ever they choose. The committee has no further campaign to make. The matter Is in the hands of the people. The Tidings hopes Its information about the circulation of eleventh hour canards is erroneous. It desires to be left in a postion to think, at least, that no unfair or snap methods have been used in this election. It Is too important to be settled on mis information that will not stand time for refutation. Saturday at 9 o'clock, every night in the week at 6. Highway Progressing Over Siskiyous The work on the Siskiyou part of the Pacific Highway is being hurried along. About 250 men are now em ployed on the road, and the grading is being rapidly accomplished. ThU work on the highway should open a good deal of work to citizens and boys Just out of high school who are. willing to work. The pay is 25 cents an hour for common laborers, 27Vj cents an hour for teamsters and other jobs with proportionate wages. They can use teams and drivers at 05 cent an hour. The board is $6 a week.
