L ALLEN Circu't Judge Cleeton or Multno mah county banded down the opinion Tuesday hat the penalties of one per cent a month imposed by the 1913 legislature on taxes not paid before April first are invalid and granted the restraining order prayed for by Roger B. Sinnott against Tax Collect or Lewis enjoining the latter from collecting the penalties. Judge Clee- ton held that taxes do not become delinquent under the law. until Sep tember first and that penalties can be collected only on delinquent taxes. Tax Collector Lewis said after the decision that he deemed the only pos sible mode of procedure would lie to take an appeal, and on request from nim me county commissioners ap pointed Friday afternoon at two o'clock for a meeting at 'which future action will be determined. To this meeting all elective officers will be invited, also Governor West and the members of the state tax .commission. The state officers are included because the decision is ex pected to throw tho entire state in a turmoil regarding what method to pursue as to tax collections. Under the terms of tho injunction penalties can be collected on ho taxes whether the first half before April first or not. Sinnot asked only that penalties on deferred half pay ments be stopped, but Judge Cleeton went farther and declared Invalid the entire provision as to penalties on taxes unpaid prior to April first.
