Toledo, Oregon, Gentlemen: ' Some months ago I wrote you con cerning the- matter of the United States Spruce Corporation in the building of their railroad from Ya quina to Otter itock, m wuicli i claim ed that the Company had taken over certain portions of the Newport Silets County Road, and asked that you have the matter examined by an Engineer to ascertain the damages If any that the county had sustained if any. : I was advised that you had taken prompt action in the matter and had employed an Engineer, that he had filed a report with the County Clerk In which he stated that the County had not been damaged by the building of said railroad. With all due respect to the Engineer who did the work, I am going to ask the Court to again have the matter Investigated. 1 wIbIi to eiy that I am personally acquainted with every rod of the said County road from the South line of the town of Agate Beach to Miner Crnek the portion of. the' road com plained of. I have probably been over the road more than a hundred times prior to the building of the Yaquina Northern and many times since it has been built, nnd have Irnveled the lioach in ffent of a portion of it more than a thousand times. 1 understand the United States Spruce Corporation was financed by the Government and the Allied Na tions. I do not question the honesty and good faith of the allied nations, and we all know that our government Is ready and willing to pay all her Just debts, and we are satisfied tha'. the matter it presented to the proper of ficials and they are shown that Lin coln County had been damaged in this matter that a speedy adjustment, will be made. Between the points named on said railroad the South line of Agate Beach and at a point where said railroad crosses Miners Creek at the South boundary of the town of Otter Roc, a distance of about four miles there are numerous places where the rail road has appropriated all of the said county road, besides crossing the county road approximately ten times. I would say that probably a mile and a half of the road has been taken by the United State Spruce Corporation.
