plans and, specification, that the Ports
of Toledo and NewporFefliall have the
right to take possession of and use
all piar.tB, materials and supplies or
parts thereof prepaired for or in use;

leases, right-of-way, and quarry priv
ileges by purchase at a value or, or
rental at m rate which shlall e deter
mined by the Engineer.
. In view of the fact that the said
Miami Construction Company has
failed to comply with the contract, j
.plans, and specifications wherein pro
vided and have also given written
notice to the Ports of Toledo and New
port that they will abandon the work
on the 21st day of November, 1919,
and in view of .the fact that there is
a large portion'of the said South Jetty
that is only partly completed end is
therefore in great danger of being
washed out, which would entail the
loss to the said Port Districts of thous
ands of dollars and it is of vital Im
portance that eatd work on the con
struction of the said South Jetty be
continued, now therefore, Be ItResolv-1
ed that the Manager of the Miami Con
struction Company, and the President
and Secretary and the Directors of the
said Company and the Bondsmen of
the said Miami Construction Company
be duly notified as by law required.

WHEREAS, The Malmtiai Construe.

with the Ports of Toledo and Newport
for the building of the South Jetty,
did on the Vlth day of November, 1919
give written notice to the said Port
Comralcsioners that owing to the fact
that the Company had "sustained such
enormous loss and aire continuing to
sustain such enormous loss in our
daily operations that It now becomes
impossible for ug to bear the burden
any longer," and that they were un
able to further finance the work, and
would be compelled to quit the work
