The Putnam Verdict.
George Putnam, editor of the
Medford Tribune, stands convicted
of criminal libel for venturing to
criticise in his paper the action of
a grand jury in failing to return an
indictment against a man apparently
guilty of an unwarranted and un
provoked assault. The distressing
feature of this conviction lies in the
fact tiiat the trial court did not ncr-
mit Mr. Putnam to furnish proof
that the statements published in
his paper were true. This is as
much as for the court to say that
no matter to what depths of villiany
and corruption a judicial body may
sink, to publish the fact of its rot
tenness, even though every state
ment be true, is a crime. Most
people will question the motive or
the good sense of a judge holding to
such a doctrine. This was very
likely the law of Russia a century
ago, but even that country has ad
vanced lieyond such absurdity.
A crooked grand jury is not im
mune from public criticism, and
neither is a crooked judge, re
called jurists need not strain their
imagination over such technical
points when the liberty of an Amer
ican citiryn is irv.,vod. Tlioro i n
law that will not be found written
in the books, and this law the peo
ple invoke when their personal
liberty is assailed. There is no
need for any branch of this Govern
ment, neither the Legislative, the
Executive, nor the Judicial, to im
agine itself supreme. Nor will
either Ixj permitted to invade the
rights of the humblest citizen.
If Mr. Putnam spoke the truth in
his article and can prove it, he will,
in the end, be acquitted of the
cl mrge against him. lie will also
be permitted to prove the truthful
ness of the matter published by

caused a court in a country that
boasts of its freedom of speech to

The Railroad Lands.
Attorney General Bonaparte re
cently received a number of inquir
ies relating to the status of lands
held under the railroad and wagon
road grants in Oregon, which have
not been disposed of by the grantees
and asking if the present holders
"have to sell the same to actual
settlers only, at the rate not exceed
ing $2.50 per acre."
The Attorney General lias replied
that proceedings will shortly be
taken to determine the rig its and
responsibilities of the Southern Pa
cific company's holding title to the
lands mentioned.
Further than this the attorney
general says he is not authorized by
law not permitted by practice of
the department to speak, lie rcc-
comends that the writers take no
expense on themselves in regard to
the matter except on advice of
counsel of unblemished reputation
and high standing. Eugene Regis
ter. Recorder Dorris, of Eugene, be
fore whom several local option eases
of that city was tried, sentenced
each of the convicted violators of
the law to pay a fine of 8200 each
and gave them a jail sentence of (i0
days. With fines like these it looks
as if men would learn to oliey the
law. The Kline cases at Corvallis
have been aflirmed by the supreme
court and the aggregate fines against
Kline foot up more than $1000,
which he will have to pay or go to
jail for about six years. Lebanon

Meeting Monday night, at which
time the boosters of the town en
deavored to get the knockers and
mossbacks to sign the pledge and
bury their hammers. A crusade of
this kind could be well lanehed all
over the whole state without do
ing any great damage to its wel
