In the matter of the void sale of a
part of lot 1 in block 1, Nye & Thomp
son's addition to Newport, Oregon, At
this time came on for consideration the
petition of James Beach praying for an
order of this court declaring void cer
tain of the hereinafter described prop
erty for alleged delinquent taxes there
on for the year 1895, when, as a matter
of fact, the taxes on said property had
becu fully paid nnd never became de
linquent, and it duly appearing to the
court therefrom that the taxes on the
following described premises, lo-wit:
Beginning at the southeast comer of
Nye & Thompson's addition to New
port, in Lincoln countv, aud running
j thence west 200 feet, thence uortti 1UU
feet, tbeuco east 200 feet, thence south
100 feet to the place of beginning, the
same Deing part ot lot l iu oiock i in
said Nye & Thompson's addition to
Newport, were fully paid for tiie year
1895, as shown by the tax rolls of said
couuty for said year, and the said taxes
thereon were not delinquent tor Huld
year ; that said property for stid year
was owned by aud assessed to Samuel
Orr, who paid said taxes (see Assess
meut Roll 1895, page C2, line 27); that
said described property was erroneously
entered upon the delinquent tax list
for said year as delinquent aud there
after said to Lincoln countv for said
alleged delinquent taxes: that there
after, at the- statutory sales by said
couuty on the 9th day of J uly, 1902,
said couuty erroneously sold said prop
erty to oue William Kidgeway; that
said petitioner, James Beach, is now
the owner of said described premises,
and the court being fully advised iu
the premises, aud having carefully ex
amined said petition, it is ordered and
hereby declared that said sale of said
described premises to Lincoln county.
