Indian Has Right to Drink.
The Supremo Court of the United
Stales, in an opiniou by Justice brewer,
Monday, grunted the petition of Albert!
lleil of Kansas for a rit of habeas
corpus. Helf was prosecuted and con-1
vhMed in tlio District Court of Kansas
or selling beer at the towu of Horton
to a Kiekapoo Indian naniel Johu But
ler, to whom laud had been granted in
severalty. The prosecution was bused
upon the theory that Butler was still a
ward of the Nation. The case was
brought to the Supreme Court iu an
original action, on the ground that iu
becoming au allottee, the Indian be
came a citizen of the United States.
, This view was sustained by Monday's
opiuiou, which concluded as follows
"We are of the opinion that, when
the United States grauts the privileges
of citizenship to an Indiau, giving him
l he beneiit of aud requiring him to be
subject to the laws, both civil and crim
inal, of the state, it places him outside

ut of Congress; that the emaucipa
tiu from Federal control thus created
cauuot be set aside at the instance of
the Government without the consent of
the individual lodiuu aud the state,
and that the emancipation from Federal
control is not aifected by the tact that

are granted subject to a condition
smuust alienation aud incumbrance, or
the fact that it guarantees to him an
interest iu tribal or other property,"
This decision apparently applies to
the Indians of the Siletz reservation
and all other ludiaus holding laud iu
bevel ally. Iu due time a decision is ex
pected declaring such laud subject to
taxation the same as that of any other
(citizen.

certain persons in Lincoln county, Ore
gon, are digging into Indian graves aud
removing the remains of. deceased lu
diaus therefrom and also removing cer
tain articles therefrom, I, desire to state
for the benefit of such persons that a
aevere penalty is attached to such an
offensti as is Rhown by section 1940, Bel-
-lineer & Cotton's Annotated Laws, of,
Orpgon, which reads as follows, to-wit:
"If any person shall willfully and
wrongfully dig up, disinter, remove or
.onvey away any human body, or the
remains thereof, such person, upon con
viction thereof, shall be punished by
imprisonment in the penitentiary not
less than six mouths nor more than
two yearn, or by imprisonment in the
onnty jtiil not less than three months
nor tviore than one year."

Our school district, No. 50, opened
school last week with a nice young
teacher, Miss Hampton.
B. O. Lockwood made a business trip
to Portland, returning Friday.
C. L. Litchfield ia heving a new house
built 011 his farm by Morris Lake.
II. F. Parmele made a flying trip to
Toledo and has not yet returned. We
guess what next?
Harry Thorp and John Block have
returned. They report Portland full
of laborers looking for jobs.
In digging for water 11. F. Parmnle
thinks he has found himself Hr.li.
Mr. Thorp, father of Alvln and Harry,
went to the valley to buy a farm, feel
ing disgusted with beach life. He re
turned Friday, fully satisfied to buy a
farm here and spend the remainder of
his days with bis sons. Mr. Thorp and
wife are good neighbors. He is a native
of England, where he was a school
mate of the late Hon. T. II. Tongue.
