filed in thisolllce by Franks Clark, contestant,
against II. E. No. 13315, made Jan. 2, 1901, for

section 25, township 7 south, range 11 w. by
John D. Campbell contestee, in which it Is
alleged that contestant Is well acquainted with
said tract of land and "knows the present
condition of the same; also that said contestee
John 1). Campbell lias not lived or made his
home upon said land within the past six
months or for for a much longer period than
six months. That ho has made no improve
ments upon said land save and excepting a
cabin and a small clearing of the probable
value of $25 nnd that he has wholly abandoned
said land for more . than six month
last past and that said alleged
absence. from the said land
was not due to his employment in
the army, navy or marine corps of the United
States as a private soldiei, officer, seaman or
marine, during the war with Spain, or during
any other war In which the United States may
