SUIT HAS BEEN BROUQHT.
The Salary Question to be Passed on
By the Courts.
Lincoln county will again enjoy
the luxury of a lawsuit, the
sheriff and the clerk refusing the
salaries set for them by the county
court at its December, ,1896, term,
and the matter is to be tested in a
suit brought by the he sheriff for
the same salary that the sheriff of
Benton county receives.
The action is a mandamus case
brought agaiiySt Lincoln county,

missioners, .And the writ directs the
defendants to appear before Judge
Fullerton at Toledo, on January 25,
1897, and show cause, if any there
be, why they do not audit and al
low the claims of the plaintifl in
the same amount that the same
officer in Benton county receives.
The only law in reference to the
salaries of the clerk and sheriff is
in the law of 1893 creating Lincoln
county. In section 8, of that act,
it is provided that '"the sheriff and
county clevk of said county shall .
receive the same fees as nre now al- .
lowed by law to the sheriff , and
clerk of Benton county." In 1893.
after the law creating Lincoln coun
ty had 'been' enacted, the legislature
enacted a law abolishing the fee
system and placed the clerks and
sheriff, on salaries, but -failed to :
provide any salary for the clerk or
shefiff of Lincoln county. The leg-! .
iskiture iii 1895 again legulated tlie
salaries oi the- various . clerks and -sheriffs'
of the state except those of .
Lincoln"- county, - and no salaries
were-tiamed for them. The supreme
court lius .decided that the clerk :
atkl' Sheriff of Lincoln county were
under the salary law and not under
fees, and ill the absence of any sal
ary named the officers interpret
their salary to be the same as the
salaries of the same officers in Ben
ton county,' inasmuch as the law
says their fees were to be the same.
, Service of the papers were made
yesterday; and the case will be
heard in com t next week. We'ather
ford & Wyatt of Albany, and Judge
W. S. Hufford of Corvallis, are at
torneys for plaintiffs in the. action.
Judge J. R. Bryson was also one of
the attorneys but was compelled to
retire from the case by reason of his
dangerous illness.
Here's One Reason.
The reason why the house has '
not yet been organized ought to. be'
apparent to the people of Oregon.
There is an effort to organize it in
opposition to all remedial legislation,
in opposition to all legislation in
favor of economy and retrench- ',
ment. This is resisted. , It in
cludes the program for Mitchell's
election. Yet the opposition to the
election of Mitchell is not the cause
of the failure to get a quorum to
appear in the house. That matter
could be and would be attended to
at the proper time and in the proper
way. But an organization of the
house in opposition to remedial
legislation is objected to. The
Mitchell meml)ers are trying to
force such organization, and it is
resisted. This, plainly, is the
cause of the delay of organization.
It is resistance to organization of
the house, on ring methods, for the
prevention of retrenchment and for
perpetuation of old abuses. Ore-
