The same question of locating a state institution away from the seat of government has lieen before the court since 1893, when the suit of Sherman came up enjoining the Soldiers' Home board from locating the home at Rose burg. In March, 1894, following the act of the legislature to purchase a site anil erect a branch asylum for the insane, a suit was instituted by the state ex rel. Taylor, a taxpayer, to enjoin the state from paying out money for such purpose. This case was decided adversely to the state, and in July, 1895, the case was again presented to the supreme courr upon the relation of Taylor, with the name of Jas. McCain, dis trict attorney, attached to the com plaint. The case was again decided adversely to tho state, and it was again presented in slightly changed ! form to the court again last Tuesday. There is a general belief that the regftn Ag- elect Hon. H. B. Miller, of Grant's Pass, pres ident of that intitu'ioii to succeed Prof. J. M. H'n. s. who recently re signed. While Mr. Miller may be a.) entirely competent and fit per son to be president of the Agricul tural college, yet the fact remains that he has never been known in the state as an educator, or even as a person especially interested in educational work. On the contra ry Mr. Miller is pretty well known throughout the state as a shrewd and an astute politician, and should he be appuinte.l president of the Agricultural college a very large number of people will be convinced in their own minds that his selection rame as a political reward.
