WASHINGTON, 1). C. Juno 21.-.
The government today lost tlis
suit In the Siipromu Joint to forfeit
unsold portions of tlio Oregon and
California railroad land grant am
minting to L300,0u0 ueres valued
nt moro thnn $110, 000,000. Tlio rail
way company was enjoined, how
ever from futuro sales In violation
of tho condition) or tlio grant until
congress hay a reasonable tlniu to

Solicitor acncrnl Dnvls nskod tlio
court o reconsider nnd restore tlio
case to tho docket for ru-nrgtimout.
Tlio application wus taken under
consideration.
HI ait I'd in I diih ,'
The suit was lustltutord In ac
cordance with a resolution of Con
gress In the federal district court ol
Oregon, on September I, 11108. Tlio
government claimed that tlio rail
road had forfeited Its rights by hav
ing violated n provision which re
quired It to sell in not moro than
100-acro traetH for not moro than
I2.no an ncro, nnd only to actual set
tlers. Tho govornm'ont sought to
provo that tho company had sold In
largo tracts to timber eomp.iulcB nt
more than $2:50 an ucre, and had
adopted u policy to sell no more to
any purchaser for tho tlmo lielng.
Tlio railroad contended tunc tho
provision was not effective, because
tho lands were unfit for settlement,
and furthermore, urged that the
government bo stopped from raising
tlio question of forfeiture because
of ln.ig neitilesceuco In tho com
imny's disregard of tho soiling pro
vision. Tried lo Force Sales
About UTi porsous who went upo'i
the lauds and claimed to bo actual
settlers, within tho meaning of the
law, brought n cross complaint, nsk
hig that tho railroad company bo
held to bo a triiBtoo for actual set
tlers a.ul required to sell to thorn.
Some 0,000 porsous who hao not
gone upon tho laud to make settle
ments but who have applied to (lie
railroad company to pun-huso liio
ocrei Intervened with u petition that
the company bo required, ns a trus
tee, to convey Intuits to them.
Stato Intervenes
Tho Stato of Oregon Intervened
with tho claim that tho stato lovled
nearly half a million dollars taxes
a ymr on tlio lands and asked that
the lauds not bo forfeited to tho
Government, In which case, tho taxes
might bo lost, but that tho rallor.id
jo required to soil them for ho bene
fit of tho government.
The I'nlon Triibt company of Now
York, trustee under it mortgage giv
en the lnml to secure $20,000,000 of
bonds used in building tho railroad
also intervened.
Tho district eourt declared tho
Ian Is forfeited, and tho ease was
taken to tho Supremo Court of Ap
peal. It wus argued Into In April.
Kfl'oets Many Locally
Tho Oregon nnd California rail
road Is now u port of tho Southern
1'aclfic System.
Many local pooplo, numbering
soveral hundred at least, are of
fcetcj by tho decision, for sovoral
years past applications havo been
mado to purchaso tho land for $2.50
an aero by many dlfforent ponons.
They alleged to bo settlors who
wajted to buy tho laud under the
conditions nan.ocl. In such cases
tho $too for the land would bo ten
dered and rofused and this would
be recorded nnd It wns oxpoctel that
If thero would later bo a doclslon
a&alut tho railroads thoso porsous
could buy for $100.
Claims Vulunlilo
In many cases tho 100 ncres ap
plied for was worth perhaps a goou
many thousand dollars on account
of the timber. , 41 . , ,
Others homestoadod on the lam

ork of building cabins and making
Improvements. They figured on hav

Fifteen persons mlrarulously ca

chartered for tho outing.
The machine went down ntnrly
100 feet. It turned over twice and
tho occupants wore thrown out land

Tho nccldont happened on a sldo
road near tho Noes place. Tho party
had been for n day's outing and was
returning to Allogauy. When the au

hill tho engine went dead and the
brakes refused to hold. Ton feet tho

Tho first leap of tho car was at

Mr. Thoiuas bellevos tluf owe
their lives to the brush which aided
materially lu keeping tho car from
crushing them as it mado tho first

ho inl.l his watch was crushed and
a tobacco can in his hip pocket wns

Mr. Moiimiii Thought Dead
Mrs. M. A. Moiikoii was at first
thought dead as she was plcled out
of the underbrush unconscious. Sev
eral of tho party were stunned and
practically every ono of them bruised
nnd their clothos torn though no
bonos woro roported broken.
So steep was tho grade that tho
members after recovering formed a
human chain and woikod their way
up to tho road. Mrs. .Monson was car
