THE COOS BAY TIMES, MARSHFIELD, OREGON, THURSDAY, SEPTEMBER 25, 1913 EVENING EDITION TOO LATE FOR CITY PRIMARY Candidates for Municipal Of fices Must File as In dependents. All candidates for municipal of fices In Mnrshlleld this year will have to go on tlio ballot as Inde pendents. This was discovered yesterday by Recorder Butler who found that the time for holding a primary elec tion to nominate candidates had passed. Last year the city adopted the state election law. The state law provides that the primary elec tion must be held forty-live days beforo the regular election and that candidates for the primaries must file their petitions thirty dnys prior to tho primary. Now It Is too lato to fllo the petitions. The city election will bo held Tuesday, Dec ember 2. Tho ofllccs of Mayor, Recorder and three Couucllmen arc to bo tilled In December. Tho terms of Councllmcn Copplc and Ferguson will expire and the third vacancy of tho Council will be to 1111 the place of John C. Merchant, who recently tendered Mb resignation. Mayor Straw Is ex pected back In a few days from Klamath Falls, It has been rumor du that ho will seek reelection for his f If tit consecutive term. It has also been Intimated thnt II. A. Cop plo would again bo candidate for Mayor. However, somo of the In fluential business men around town havo been talking of endeavoring to get a now candidate to come out for Mayor and hnve both Straw and Copplo keep out, figuring that It would bo butter for tho city to eli minate so far as uosslhlo all the old partisanship and strife. What hns been done or who Is considered lias not yet been given out. It is expected that Recorder Utitler will again bo candidate for reelec tion. Councilman Vcrgusou bus not stated that ho will be a candidate for reelection, but many will urge him to serve again on account of tho excellent record ho has made. Whether R. A. Copplo will be can didate for the Council again If he doesn't run far Mayor has not been stated. City Recorder Ilutlor Ib now regis tering voters for the election and tho registration to date has been much greater than tlilu early any previous year. There Is over u month yet In which to roglster both for tho city And state elections. Tho regis tration will be the last one for per manent residents of prci'lucls, the now law not requiring an now regis tration except wliero tho voter changes precincts. LOS A N(! 10 LHS, Sept. 2.I. Imlgo Itledsoe, of the Superior Court, halv ed a point in the Illxby morality trial today and divided it between tho millionaire who Is striving to prove that he was a victim of u ring of girl blackmailers and Octtivlus Morgan, an elderly architect. The latter Is the witness who declined to testify regarding any knowledge he might hnve of the .IoimiuI! resort and Its former Inmates, on the ground tlwit It might degrade him. The court ruled that Morgan might testify but only to such matters as should not tend to hurt' his reputa tion for respectability. The Court Instructed the architect to testify, but at tho saiuo time warned tho at torneys that If anything were brought out to show undue Intimacy In tho rotations of the witness with any of those concerned In tho trial, the' en tire testimony might be stricken out. Ulxby's attorney lmil depended on Morgan's testimony to prove that not only Illxby. but many other prominent and wen It by men of Los Angeles, had been marked ns prey by black mailers, .Morgan was called to the stund nnd questioned concerning tho nlleged statement by him that he hud given the attorneys representing tho for mer girl Inmates of Jonquil $2.00 to avoid being made defendant In a suit which might ruin his reouta- t Ion. Acting on tho court's ruling, however, Morgan replied to ninny questions with the statement that to answer would degrade him. Morgnn admitted however, that he mot attorneys representing tho Jon quil girls several times last May and June and had given them throe checks, which ho Identified In court. Tho checks were not admitted as evidence, hut the dofenso stated thoy wero glvon for amounts aggregating fLTtOO. Judge llledsoo permitted some evl donco about tho attorneys for tho al leged girl blnckmallors to go Into the record because, ho said, ho wishes to have charges made ngnlnst them made boforo tho Los Angeles liar As sociation.
