CITY COUNCIL THERE WILL
MEET TONIGHT TO TASS ON
BELL'S APPLICATION FOR ONE.
COQUILLE, Ore., Dec. 26. Tho
Coqullle city council will meet this
evenlnc to net on the application of
Seymour H. Bell for an electric light
ing and power franchise. Judging
from expression of leading citizens,
no franchise will bo granted tonight
and nono will be granted until some
radical changes are made In the
franchise as submitted by Mr. Bell.
Tho Coqullle Sentinel yesterday
had the following story on the fran
chise: "At a meeting of the citizen's of
Coqullle held in the court house
Tuesday evening, for the purpose of
ascertaining tho public sentiment in
regard to granting a twenty-year
light and power franchise to Sey
mour H. Bell it was decided that
the people are not In favor of grant
ing the franchise drafted by Mr.
Boll.
"Mr. Bell presented a request for
a franchise at the last meeting of
the city council. The council, not
feeling like granting this franchise
without hearing the sentiment of
tho public on the question, postpon
ed action on it. For the purpose of
ascertaining the public sentiment in
regard to tho matter they called a
moetlnc of the citizens to be held
In tho circuit court room at the
court house.
"Owing to the storm and the short
notice the attendance was not large
but the voice of those who were
there was decidedly not In favor of
giving away such a valuable thing
aa a franchise upon the terms de
sired by Mr. Bell. It was general
sentiment that It would be advan
tageous to the town to have Mr.
Bell's company operate here but
that the town should not pay the
price asked by him for the privilege
of having his company operate here.
The-principal objection to the fran
chise desired by Mr. Bell was In re
gard to the arc lights to be paid for
by the city. As the franchise is
drafted the city would have to pay
7.50 per month for each arc light
no matter if they use ten or fifty. It
was suggested that the city council
employ expert legal advice and draft
a franchise that the city could afford
to grant the company and if they
wanted to accept that the public
would support the new company to
the best of Its ability."

Bill In Senate Benefits Indictees Who
Cannot Get a Trial.
WASHINGTON, D. C, Dec. 26.
Senator Borah, -of Idaho, introduced
a bill requiring Federal courts, un
less a good cause to the contrary is
shown, to dismiss Indictments against
persons who through no fault of
their own are unable to obtain a trial
during the term of court following
that In which the indictment was re
turned against them.
Tho bill further stipulates that
when a defendent objects to post
ponement or demands, a trial ground
for continuance on the part of the
government must be set forth in a
sworn statement and a copy served
upon the defondant five days before
the motion for postponement Is to
be heard.
This bill Is aimed at what Senator
Borah rogards, and what President
elect Taft believes, to bo ono of the
greatest evils In our Judicial system
tho delays In bringing criminal
cases to trial.
This bill affects such cases as that
of ex-Congressman and Land Com
missioner Hermann, of Oregon, who
for three years has been under In
dictment In Oregon, but up to this
day has not been triod. Borah's bill
Is not retroactive, but would, if pas
sed, guarantee Hermann a trial at
this term of court, or else result in
dismissing Indictments against him.
It would hav the same effect on tho
Williamson case and other land cases
long ponding In Oregon.

FOR COQUiLLE
ORGANIZATION OP FARMERS AND
MERCHANTS WITH S23.000
CAPITAL IS PERFECTED.
COQUILLE, Ore., Dec. 26. At a
meeting this week the organization
of tho Farmers' and Merchants' Bank
which was started last year was con
sumated. The company was organ
ized about a year ago but for various
reasons the project was not carried
to a conclusion. The original mem
bers of the company decided to car
ry out their plan and while some of
the stockholders disposed of their
stock the company Is practically tho
same. The company Is incorporated
at $25,000.
The foundation for a building was
laid last year on the corner opposite
the Hotel Coqullle on Main street,
but that was as far as the building
was constructed. While the company
owns this corner it has not been de
cided whether the bank will be. lo
cated there or not.
The board of directors Is composed
of R. S. Knowlton, G. A. Robinson,
R. H. Mast, E. E. Johnson and Geo.
Bellino.
The officers are R. S. Knowlton,
president, G. A. Robinson, 'vice pre
sident and R. H. Mast, cashier.
BULL ELKS BATTLE FOR
SUPREMACY OF HERD
Have It Out in Golden Gate Park
Fight of Half an Hour Ends
Fatally to One.
SAN FRANCISCO, Dec. 26.
The herd of a dozen elk In Golden
Gate Park has been reduced by one
md the head of the vanquished bull
vlll be added to the natural history
collection In the Memorial Museum.
Two great bulls fought for more
.nan half an hour for supremacy, and
he beaten, one, fleeing, was gored
In the flank by his pursuer and
.o terribly wounded that he had to
be killed.
The two bulls, after many calls of
leflance, began the fight which end
ed In the death of one. When one
'lull gained a decided advantage, the
weaker animal tried to escape from
the paddock, but the victor pursued
him. Driven Into a corner, the vic
tim, before he had time to turn, was
ored twice In the flank, the huge
antlers of the antagonist ripping
reat holes In the flesh.
The fatally wounded bull was
killed a short time afterward by or
der of the park superintendent. The
head is now being prepared for ex
hibition In the museum.

HARDY, Ark., Dec. 26."" Mrs.
Maud Pepoon, wife of Henry Pepoon,
a farmer on Blue Clay Creek, got up
the other morning and proceeded to
search her husband's trousers, as was
her usual custom, but Instead of find
ing the customary collection of small
change, she grasped a giant bullfrog.
Her wild shriek woke her husband,
who leaped from his bed, intending
to tell her it was all a Joke, but she
already had rushed out of tho door
and Into the adjoining woqds, still
screaming.
Pepoon pursued her, and both
might have been running yet had not
their wild flight been suddenly halted
by a big black bear rushing ferocious
ly at them from the opposite direc
tion.
Tho Pepoons whirled Instantly and
rushed for their dwelling, t.he bear
after them and gaining. Just as they
neared tho clearing they noticed
their house was on flro, probably due
to the overturning of a kerosene
lamp In their hasty exit.
To escape the bear both Jumped
Into a well, from which, almost dead,
they were rescued after neighbors
shot tho bear. The dwelling was
burned to ashes.
