Action to Recover Railway
Grants In' Oregon Not Likely
to Be Heard Now.
PORTLAND, Dec. 10. Asking for
a speedy trial of the Oregon-California
Railroad land grant cases, the
attorneys for the railroad and the
Union Trust Company, trustee of the
mortgage bonds, as well as for the
Interveners In the suit, some of
whom 'claim to he actual settlers on
the land, appeared before Judge Wol
verton In the United States Circuit
court.
Senator Qearin appeared for the
Trust Company, Attorneys Lafferty
and Murphy for the lnterrentors and
Fenton for the railroad company.
Th'e latter will file a demurrer to the
Government's charges, but on ac
count of the crowded docket In
the Federal Court, It Is Improbable
'that the case wilt come up for hear
ing before February. The docket
now Is filled with jury cases until
February 1, and It will be impossible
Co hold a hearing before then. Three
different 'b'ills 6f Intervention were
' filed some time ago on behalf of ap
plicants for 'the land, who were re
fused the sale by the railroad people.
' The case was instituted "by the
Government to condemn the land
given to the Oregon-California Rail
road In a grant of 1868 for alleged
breaking of the grant's provisions.
The Government's stipulation was
'that the'la'hd was to be sold to actua1
settlers o'nly, in areas not larger than
160 acres o each one and at not over
$2.50 an'acre. The Government al
leges that the railroad company has
broken erery one of these provisions,
and on this account It Is attempting
to forfeit this land to the Govern
ment.' There are about 100 settlers
on the land in whose behalf Attor
neyXiafferty Is appearing. Attorneys
Dan Murphy and Leavengood, of
Roseburg, filed long bills of inter
ventlon a short time ago on behalf
of over '4000 clients who are said to
have applied to the railroad company
for the'land, agreeding to pay $2.50
an aero for. same.

here with two greyhounds and two
staghounds, oh his way to his lodge
on the Columbia river, eight miles
below here, where a party of friends
are to Join In a three-day coyote
hunt. Mr. Coffin Is secretary of the
Washington Sheepmen's association
and owns sheep in the Horse Heaven
country, where tfid hunt will be
made. Five or six men and a dozen
trained dogs will take part in the
hunt. It is an annual affair. Last
year the series of hunts netted 30
coyote skins and the year before 54
was the record. This year the ani
mals are reported plentiful again.
Coyote hunting as practiced here
Is one of the most exciting sports of
the northwest. The hunt Is on horse
back, and trained horses are used.
Each man has two or three dogs on
a rope and holdB the two loose ends.
The riders approach as near the
?ame as possible and then let loose
the dogs. It Is a case of follow the
hounds after that at breakneck
speed, and the coyote has a habit of
always picking out the toughest
country for the chase. The grey
lounds do the catching and the
'leavler staghounds the killing. The
Iders keep up with the procession as
jest they may.
No guns are used; It Is simply a
ace over rocks and sagebrush, with
be speed and cunning of the game
pitched against the speed of the
greyhounds and the ferocity of the
staghounds. Sometimes the coyote
jvins; sometimes the dogs. The aver
age of past years has been three dead
coyotes for each day's hunting. On
iccount of the ctiaracter of the
ground covered, the horses and
riders, at the speed they go, run a
jonstant risk of a fatal fall.

gon Railroad Commission has dis
nissed the proceedings against the
voos Bay, Roseburg & Eastern, in
which that road was accused of dis
crimination against the California &
Oregon Coast Steamship Company.
The case arose from a controversy
jver the division of the freight rate
on a merry-go-round from Coqullle-
o Portland via Marshfleld. The Cali
fornia and Orogon Coast Steamship
''ompany maintained that the rail
way should receive only tho local
'ate from Coqullle to Marshfleld on
t, tho ship to receive the $50 from
Marshfleld to Portland. The railway
ihowed that It had a general agree
ment with tho steamship company
hat on all business consigned
through, tho freight was to be divid
ed equally.
