SALEM, Ore., Oct. 30. Anti-prohibitionists
won a great victory in
the Oregon Supreme Court when the
decree of Judge H. K. Hanna, of
Jacksonville, enjoining the county
court of Jackson county from mak
ing an order declaring the entire
county "dry" was affirmed. The order
of the county court was based on a
provision of the local option law
enacting prohibition in an entire
county where the majority of votes
cast was in favor of prohibition, re
gardless of whether any incorporat
ed town or city within such county
might have voted against prohibi
tion. Jackson county as a whole
voted in favor of prohibition last
June, but the city of Medford did
not. The city brought an injunction
Bult against the county court on the
ground that the Medford charter pro
vided that the city had the right to
license the sale of liquor and was,
therefore, not amenable to the local
option law. Judge Hanna decided
that the prohibition order of the
county court was void so far as the
city of Medford was concerned, and
this contention Is upheld by the Su
preme Court on an appeal from Han
jia's decision.
The opinion of the Supreme Court
which Is written by Justice Moore,
means that any incorporated city in
Oregon may, by a special election,
amend Its charter exempting It from
the operation of local option laws, so
that residents outside the town can
not vote it "dry."
