NAVY'S ACTION IS NOT APPROVED Clash with the Department Comincrco Over Customs Duties. of Port Townsend, Wash., Oct. 8. A test of supremacy between tho navy and labor and commerce de partments will be given when'' a de cision Is reached in the case of the British tramp steamship Netherlee, which reached port this afternoon, seventy-eight days out from Nor folk, Va., laden with coal for the naVy and consigned to the Bremer ton yard. When the vessel was char terde by the navy department for the trip the owners In England reduced the price of the service on the assur ance of tho department that the ves sel would bo exempt from all cus toms dues. Today, however, it de veloped that tho bureau of naviga tion of the labor and commerce de partment is sole authority in matters of this kind, with the result that Col lector Harper refused to enter the vessel and Issue a .permit to dis charge until sho paid the $1 tonnage tax, which In the case of the Nether lee requires an advance of $2,746. Captain Rankin produced his char ter In support of his refusal to pay, but the customs officials wero obdu rate, with the result that a large shipment of special steaming coal for the use of tho Pacific squardon Is now held up here. Customs officials referred tho matter at once to the bureau of navigation, while Captain Rankin cabled home to tho. owners for Instructions. Tho authorities hero declare that the navy depart ment exceeded Its authority in mak ing any promise of immunity from customs regulations. It Is expected that the complica tion will bo straightened out by the navy department adding customs dues to tho amount agreed upon In tho charter of tho Netherlee.
