Tho trial of Senator Borah In Ida
ho for alleged land frauds Is being
watched by many of tho brilliant
senator's lrlends with perfect con
fidence that he will be acquitted.
Certainly It will be tho earnest wish
of all who have obiorvea Ills career
that he will be able to secure a com
plete vindication at tho hands of the
Jury. Ills friends attribute his in
dictment to the bitter enmity of
United States District Attorney
Rulck, who is chnfged with forcing
tno grand jury to return the Indict
ment. Whether Ituick has sufficient
physical or hypnotic power to accom
plish such a feat over from twelve to
twenty-throe men, cannot bo stated
at this distance. Even Borah is not
Immune from indictment and pun
ishment if ho is guilty.
But in tho courso of the trial it
developed that the quest for convic
tions in the land fraud cases had
become so urgent ''that peculiar
methods were i esorted to for tho
purpose of procuring evidence and
that for the sako of obtaining immu
nities or profits both criminals and
cjotcctlves had introduced vicious
practices Into tho channels of jus
tice. The history of nearly all at
tempts to purify tho political system
seems to ho a history of spasms.
For a time corruption Is rampant,
until some strong official hand is
raised to correct or punish. Then
tho current is reversed and runs as
strongly In tho direction of morals.
The public, which was callous before,
is horrified at conditions which it
long knew to exist and judges, juries
and press hurry the accused to con
viction and prison. This spasm in
favor of morality continues until
prosecutions become fanatical and
Intemperate and tho thinking public
disgusted, whereupon a reaction sets
in and a halt is called. Perhaps tho
prosecution of Borah and tho
methods and motives of his prosecu
tors mark a turning point and the
beginning of a reaction in the public
mliul, and that the era of rabid pur
suit of criminals In high places is
drawing to a close. Whether this
is so or not, It cannot be denied that
tho not gain In favor of public
morals and honesty is great. It will
have to bo admitted, however, that
very little of all tho vast losses
which rogues, convicted and uncon
victed, havo imposed on the people,
has been recovered, and all tho cor
rupt wealth of millionaire swindlers
still remains In swindlers' hands.
Tho stolen goods nro still with tho
thieves and thero is no effort made
to recover them. Untold acres of
laud fraudulently acquired are held
out of reach of tho people who need
them. Would it not bo moro useful
and sensible to employ all tho
money, talent, ingenuity and senti
ment which nro being expended In
punishing n few unfortunate knaves
in effecting a restoration to tho pub
lic domain of what has been stolon?
Surely tho great stato of Oregon
would faro and fool better.
