As Notlco will,be served this morning on the proprietors of all saloons In precincts 40, 55, 5G and 57 that they must suspend business within the next 10 days In compliance with the prohibition- order voted under tho local option law at the city election In 1905, says tho Portland Oregon ian. Thattho order of tho county court enforcing prohibition In these precincts was never recorded in the journal of tho court and that the sa loons have been operating Illegally for the past two years has Just been discovered and District Attorney Manning will today serve notlco or dering them to close. There are 29 saloons In the pre cincts that will bo affected .by the or der of tho district attorney, and all these must close their doors. There are also three saloons In precinct 58 that will bo forced to close. This Is duo to tho fact that these saloons were Included In precinct 57 at the time tho vote was taken, but aro now outsldo of It owing to a change In boundaries. Tho discovery that tho prohibition voto of '1905 had nover boon put in to effect In the four precincts named was mndo by Rev. G. L. Tufts, of tho Pacific Coast District of tho Reform Bureau. After obtaining a now or der from tho county court covering tho disti-ict, ho called attention to the situation at a mooting In tho Forbes Presbyterian church Sunday night. At this meeting a commttteo was ap pointed to tako up tho matter and this commttteo waltod on District Attornoy Manning yesterday morn ing. As a result of this conference, Deputy" District Attornoy AdaniB mudo a' thorough inspection of tho records' of tho olectlon. It was found that tho county court had Is sued an order Juno 23, 1905, direct ing that tho saloons closo in com pliance with tho voto. Tills order, however) was nover recorded in tho journal ,of tho court. Consequently it was never brought to tho attention of the city license dopartment, or of tho district attornoy, and so far as Is known, tho saloons wero never notified to closo their doors. When this mattor was called to tho attention of tho court threo weeks ago.,, a nunc pro tunc order was made directing tho saloons to close. In compliance with this order a deputy of tho district attorney's office will today seive notlco on the proprietors of these saioons. Mr. Manning said lust night that he would give them 10 days In which to wind up their affairs and go out of business. No one seems to know how it hap pened that tho order of the court wa3 not recorded. County Clerk Fields is out of the city and could not bo interviewed in connection with tho matter. Tho closing of these saloons will mean a reduction of $24,800 a year In the revenue of the city. It Is not believed that the licenses can be transferred to toher locations and tho number of saloons in the city will therefore be reduced from 439 to 408. Under the new license law it will bo impossible to Increase this number until the official census of the city shows more than 500 people for every saloon doing business. $ f 4 2 f $ ! Miss Emma Flltcrott, ol North Bend, Is the guest of Miss Nettie Beyers this week. James Stock, Summer's lacding stockralser, was a Marshflold visitor this week. C. H. Chadbourne, a retired busi ness man of Princeton, Minn., Is registered at the Hotel Sumner. Mr. Chadbourne is on a pleasure and in vestigating trip, and says that Catch ing Inlet and Sumner farms look more prosperous than farms in any other part of the country. W. C. Harris received over four tons of flour, feed and other merchan dise by launch Sumner yesterday. Mrs. E. H. Beyers returned home yestorday, after a two days' visit to Marshfleld. Quite a number of the young folks of Sumner assembled at the hall yes terday evening and had a social danco. They had a fine time and pronounce the floor the second to none in Coos county. Fine Houser, stage driver on the Coos Bay-Roseburg line, returned from Roseburg last night, where he was on business for the stage com pany. Robert White, a retired stock raiser of Eastern Oregon, is rusti cating at Sumner a few days. Geo. Richards was buying cattla hero yestorday for tho Hall Meat Market. Tho city council held an adjourned meeting last night to pass two or dinances, 178 and 179, for the im provement of Sheridan streot from Washington to Pennsylvania avenue, and of Pennsylvania avenue from Sheridan street to Coal Bank Sloug'h, to a point approaching the proposed bridge across the slough. These were passed and bids will be adver tised for immediately, the time limit for the completion of each exten sion being sixty dajs. It was stated that Mr. Perhnm, who secured the contract for im proving Broadway and E streets, had not filed his bond, and on motion tho contract was let to Masters & McLain, the next lowest bidders. The resignation of Councilman F. P. Norton was read, and on motion was accepted. The mayor stated he had been too busy to select a man for the vacancy and would take more time for it. A communication was read from R. E. Shine, stating that the South ern Oregon Company would give the city two lots, 40 and 41 in Block 9, New Bedford Addition, for a water reservoir site, a strip 50x110 feet, and in return would expect tho city to dedicate a str'p of 0x390 feet north of tho old cemetery for the purpose of -opening Second street. Tho communication was placed on file. The matter of the Cedar street bridge in the northern part of the city was discussed and Mr. Hlsner, employed by the County Court, said ho hail torn tho bridge planking off and found that tho framework was unsafe. Also that ho had no right, as an employe of tho county, to pro ceed with rebuilding It, as tho city had parsed an ordinance! of improve ment, extending into tho tcrritoiy spanned by the bridge. Mayor Straw called the attention of tho council to the fact that com plaints were made that tho Pacific States Telephone Company was using more poles and guy wires in a cer- i tain portion of tho city than allow able, and it was ordered that the company be required to remove such. Tho mayor also brought several other items to tho attention of tlib council, which he said he was pow erless to correct, for tho reason that thoro aro no ordinances covering them. Among theso were: Hushing sewers, disposition of garbage, teira cotta and stove pipes extending through roofs. On motion of Flana gan, a committee was appointed to purchase n suitablo garbage dumping ground for the city. This com mittee consists of Messrs.
