ACTION NOT DETERMINED Government Representative Refuses To State What Course Will Re Taken. T. S. Minot, who roprosonts sev eral scoro of applicants in suits pond in b against the Southern Oregon Land Company, has tho following interview in the Portland Journal: "Suits involving 93,000 acres agalnBt the Southern Oregon Com pany, of which Elijah Smith, his brother, Prosper W. Smith, and William W. Capro are tho principal stockholders, will probably be the next movo on tho part of tho United States to enforce tho conditions im posed in land grants in Oregon. Tho Southern Oregon Company is the presont ownor of tho land granted to tho old Coos Bay Wagon Road Com pany, which was granted a strip of land between Roseburg and Coos Bay, a distance of about 65 miles. T. S. Minot, a lawyer of San Francisco, is in Portland in the Inter ests of a largo number of applicants for tho land, and has prepared a bill of complaint and information show ing that his clients made legal ap plication for tho land and asking that tho courts compel the company to sell. " Mr. Minot has submitted all tho papers which contain tho evi dence ho has gathered a"Inst the company to Burdetto D. Townsend, assistant United States attorney, who was sent out from North Dakota sev eral weeks ago as tho representative of Attorney-General Bonaparte in all Orogon land grant matters. In dis cussing the situation today, Mr. Minot said: "This action is brought to compel tho company to sell its lands at $2.50 an acre, which it has refused to do. Tho land is valuable for grazing pur poses and diversified farming. Its timber resources are wonderful. Somo of tho land will run 15,000,000 foot to tho quarter section. "We have made application for tho land and the names of 110 appli cants appear in this complaint which I have submitted to Mr. Townsend. When wo visited tho offices of tho company at Empire City, with more than $100,000 to pay for tho land, our applications woro turned down by R. E. Shino, secretary of tho com pany, who ordered us out of his office. We showed our papers, of fered $1,000 in payment for each sec tion, ?400 for tho land and tho rest for taxes which the company has paid since it secured the grant. This raado a legal tender and will bo good ovidonce in tho courts. Somo of the land was sold at first under the obligations of tho grant at $2.50 an acre. Later tho road was accepted, although in many places no work had been done and to this day there is nothing but a trail to show that such an enterprlso was ever con templated, " 'I have been gathering the evi dence which I havo submitted to Mr. Townsend for the past two months and believe that it is suffi cient to compel the company to sell its lands. Supreme court decisions havo been niado In tho past which uphold us in our contention. The company has violated its privileges according to tho provisions of the grant, and now holds tho land at $30 an ncre, making a total valua tion of about $3,000,000. " 'The grant was made to the Coos Bay Wagon Road Company In 1870. Later it passed to the Oregon Southern Improvement Company and finally to the Southern Oregon Com pany, of which Elijah Smith, Prosper W. Smith and William W. Capro are tho principal sotckholders.' " "What action the federal govern ment will take in tho matter could not be learned today. Mr. Town send refused to discuss the caseT'but admitted he had received the evi dence Mr. Minot had submitted." RAILROAD LINKS FOR MEXICO Concessions Granted To Representa tives of American Capital.
