Pioneer Publishing Company Madras, Oregon - 1 LAND OFFICE RULES IN FAVOR OF SETTLER Homestead Entered Before Survey May Be Held Against State School Selection Washington, March 4. De cisions of State Supreme Courts to the contrary notwithstand ing, the Interior Department is holding that where a person qualified to make a homestead entry makes bona fide settlement uaon unsurveved lands with the intention of makng homestead entry thereof when the land shall have been surveyed, he may make such entry even though the land settled upon is found upon survey to be a portion of second 16 or 36, and that in such case the state may select other land in lieu of that lost by such prior settlement claim. This has been the ruling of the Interior Deparment for a number of years. The Supreme Court of the State of Washing ton, January 4, 1912, held that , sections 16 and 36, whether surveyed or un-surveyed, passed to the state by virtue of the enabling act, and that the title of the state could not be defeated by a settlement claim initiated thereon prior to survey under the homestead laws. The Supreme Court of the State of Idaho also ruled similar ly, and so have other states su preme courts, but those decisions have not been binding upon the Federal Government, and in fact have been virtually overruled by contrary holdings of the In terior Department. From this record it is to be inferred that the Interior De partment will not recogniz that a state's title to a school section attaches until the particular sec tion is surveyed, and then only in the event there is no previous ad verse claim. Where the state loses a section by this means however, the department holds it is en titled to make an indemnity se lection, but cannot acquire the particular section on which a prior settlement was made. ITEMS OF INTEREST NEW MAIL SERVICE Advices received from The Dalles are to the effect that better mail service will be had between Th Dalles and Central Oregon points as soon as the matter can be passed on by the Post-office authorities at Washington. Bids were recived last week for the transportion of the mail from The Dalles across the Columbia river toGrand Dal les to connect with the North Bank road for interior points thus abolishing the circuitious routing whereby mail from The Dalles heretofore has had to go to Portland, and return by the North Bank road before starting up the Deschutes Canyon.
